As we have recently discussed, the Division reviewed the plans for
the West Pit diversion work which were recently forwarded to you,
Based upon a larger design storm event and other conservative
assumptions, a revised design for the drainage channels in the West
Pit has been composed. A copy of a memo from David Berry is
enclosed. The memo contains an explanation of the design
parameters and specifications. Major differences between the
revised design and the earlier design are a wider bottom width and
riprap installation in the entire length of reconstructed channel.
A field directive with the recommended design specifications is
being delivered to Phil Kessler this week so that he may give the
Division an estimate of the cost for this work. A draft of that
document is also enclosed for your information. The Division
proposes to have Mr. Kessler proceed with the West pit work
immediately after reclamation of the orphan pit is~complete. In
order to do so, it will be necessary to revise the "Agreement
Concerning Diversion of Water into Magpie Creek" as discussed in my
letter to you dated October 26, 1993. I have reviewed the comments
in your October 29, 1993 letter regarding the agreement. Your
letter included two general comments:
1. You indicated that the entire Magpie Creek embankment
should not be removed. The Division intends to remove only
that portion of the embankment necessary for installation of
the proposed drainage channel. This will be specified in the
field directive given to Mr. Kessler. The channel will enter
Magpie Creek as far to the east as possible while allowing for
an appropriate angle at the junction of the two channels. As
such, the language of the agreement could be revised to read
