Section II -Revisions Since November 3, 2001 <br />(Documents referenced aze located in the Permit and supplemental files unless otherwise <br />indicated.) <br />Two technical revisions (TR) were processed subsequent to the Permit Renewal of November 3, <br />2001. TR-34, with a decision date of January 6, 2003, provided for revised post-mining <br />topography of the long-term spoil storage area. TR-35, with a decision date of December 10, <br />2003, provided for the receipt and disposal of fly-ash generated from a power plant that intended <br />to use coal from a source not previously approved. <br />Two minor revisions (MR) were processed subsequent to the Permit Renewal of November 3, <br />2001. MR-39, with a decision date of March 10, 2004, updated the identification of interests <br />portion of the PAP. MR-40, with a decision date of Mazch 19, 2004, extended the period of a <br />variance from contemporaneous reclamation so as to permit continued use of flyash in the <br />backfill of Pit B in the reclamation plan. <br />Section III -Status of Permit Stipulations <br />There are no current stipulations on Permit C-1981-028. Stipulations 1, 2, 3, 4, 6, 7, 8, 9, 10, 11, <br />12, 13, 14, 15, 16 and 18 of the original Permit were resolved during the first five-year permit <br />term. Stipulations 19, 22 and 27 were resolved during the second five-year permit term <br />(Findings, 1992). Stipulations 20, 21, and 28 were resolved during the third five-year permit term <br />(Findings, 1998). Stipulations 5, 17, 23, 24, 25, 26, 29, 30 and 31 were resolved during the fourth <br />(November 3, 1996 -November 3, 2001) five-yeaz permit term (Division Permit System). <br />Section IV -Status of Applicant Violator System <br />An update of the Applicant Violator System (AVS) database associated with MR-39 (Mazch 10, <br />2004) was accomplished. There aze no current violations against the Permit. <br />Section V -Decision to Require Revisions or Additional Information <br />This midterm review evaluated compliance of the Permit with all of the Rules. Only specifically <br />required items, and items requiring reasonable revision or modification of the permit provisions <br />to ensure compliance, or explanations of acceptable compliance, with the Act and the Rules <br />requiring action are described below. In summary, the review identified a need to update the PAP <br />with regard to the map and list of owners of contiguous surface azeas [Rule 2.03.4(7)], and <br />recognition that the once-applicable Air Pollution Control Plan identified on page 124 of the <br />PAP has been allowed to expire, and Air Pollution Emission Notice (APEN) procedures now <br />apply [Rules 2.05.6(1)(a) and 2.03.10]. <br />Page 4 of 7 Pages <br />
