MacGuire
Lake City Mines
Lake City, Colorado 81235
Re: Golden Wonder Mine - File No. 78-91 /
Ute Mine - File No. 78-92
Uear f4 r. MacGuire
It nos recently come to the attention of our Division that the Golden
Wonder Mine is underyoing expansion with plans for the yreatly increased
production. Your existing mining and reclamation permit for this
operation is for U.6 acres of surface disturbance under a limited impact
permit. Tnis pennit also limits you to 7D,000 tons or less of annual
extraction. Any expansion oeyond this limited impact pennit is in
violation of this pennit and the Mined Land keclamation Act.
Please be advised that our Division will plan an inspection of this
operation in the very near future. If you are found to be in violation
of your pennit, the Mined Land keclamation Board can consider finding
such a violation at a reyularly-scheduled meetiny after said inspection.
If a violation is found, the Board is empowered to mandate corrective
actions and may issue a Cease and Desist Urder for this operation. The
Board, after such a violation is found, inay also consider levying
possible civil penalties during a formal public heariny. Said civil
penalties can be substantial and severe. Section 124 of the Act governs
these procedures, and a copy is enclosed for your reference. (You would,
of course, be properly notified of all of these meetings.)
Although annual fees have been paid for this operation and for the Ute
Mine, no notices of intent to continue mining have been received by our
Division. These notices should describe the mining and reclamation
activities that have occurred at the mine sites and any activities
planned for the upcoming year. These should be submitted as soon as
possible.
423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel. (303) 866-3567
