To date, Peabody has successfully resolved seven stipulations. <br />Listed below is each of the thirteen stipulations and the current status. <br />Number Stipulation Status <br />WITHIN 30 DAYS OF ISSUANCE OF THE PROPOSED DECISION <br />FOR THE SENECA II-W MINE, THE APPLICANT MUST UPDATE <br />THE POST-MINING LAND USE DESCRIPTION OF THE PORTION <br />OF THE PERMIT APPLICATION TO INCLUDE COMMENTS <br />RECEIVED CONCERNING THE PROPOSED USE BY THE LEGAL <br />AND EQUITABLE OWNERS OF RECORD AS WELL AS THE <br />APPROPRIATE STATE AND LOCAL AGENCIES WHICH WOULD <br />HAVE TO INITIATE, IMPLEMENT, APPROVE, OR AUTHORIZE <br />THE PROPOSED USE OF THE LAND FOLLOWING RECLAMATION. <br />THE FOLLOWING SPRINGS WILL BE MONITORED TRI-ANNUALLY <br />FOR DISCHARGE, pH, TEMPERATURE, AND CONDUCTANCE: S-1 <br />S-5, S-7, S-4, 5-23, 5-41, AND OLSON SPRING (5-45), <br />IN ADDITION TO THE ABOVE FIELD PARAMETERS, THE <br />FOLLOWING SPRINGS WILL BE SAMPLED IN AUGUST FOR <br />WATER QUALITY ANALYSES: S-9, 5-41, AND OLSON SPRING <br />(5-45). <br />THE WATER QUALITY PARAMETERS TO BE SAMPLED FOR ARE <br />LOCATED IN TABLE 7-77 OF THE PERMIT APPLICATION. <br />WELLS AT SITE GW-42-S2W-1, 2, 3, 4, 5, 6A AND 7A WILL <br />BE MONITORED MONTHLY FOR WATER LEVEL (TO BE REPORTED <br />IN FEET ABOVE OR BELOW LAND SURFACE DATUM) AND FIELD <br />PARAMETERS (TEMPERATURE, SPECIFIC CONDUCTANCE AND <br />pH). QUARTERLY WATER QUALITY SAMPLES WILL ALSO BE <br />TAKEN AT EACH WELL FOR THE SAME PARAMETERS AS <br />REPORTED IN THE PERMIT APPLICATION IH TABLE 7-77. <br />4 PEABODY COAL COMPANY MUST SUBMIT T0, AND, HAVE APPROVED <br />BY THE DIVISION A PLAN FOR MDNITORING SPOILS WATER. <br />THIS PLAN SHOULD INCLUDE INSTALLATION OF SPOILS <br />MONITORING WELLS, A SCHEDULE OF MONITORING WELLS, A <br />SCHEDULE OF MONITORING AND A LISTING OF PARAMETERS <br />TO BE MONITORED. THIS PLAN MUST BE SUBMITTED WITHIN <br />30 DAYS OF PERMIT ISSUANCE. <br />PEABODY COAL COMPANY WILL SUBMIT AN ANNUAL HYDROLOGIC <br />REPORT TO THE DIVISION FOLLOWING EACH WATER YEAR <br />(OCTOBER 1 TO SEPTEMBER 30). THIS REPORT SHALL <br />INCLUDE ALL OF THE REDUCED AND TABULATED SURFACE AND <br />GROUND WATER DATA COLLECTED DURING THE YEAR.
