{ « • • <br />2 <br />On December 11, 1979, a cultural inventory rae conducted of the proposed <br />gravel pit and adjacent areas. <br />On December 28, 1979, BLM received a Maiver docuwent, dated December 21, <br />1979, Eros MRC stating that they had no objection to the sale and <br />rewoval of up to 90,000 cubic yards of gravel Eros the subject public <br />lands ewbracing the Disappointwent #4, #6, #9, #10 and the Red Spot #12, <br />#14 unpatented wining claiws. <br />On January 29, 1980, the environwentel assesewent addressing your <br />proposal rae cowpleted along rith the decision to sell the requested <br />gravel subject to an attached 'Operating end Reclawation Plan for the <br />Disappointwent Gravel Pit, CO-030-MPO-1•. <br />On February 4, 1980, the contract rae fully executed rich the signing of <br />the contract forty by the Montrose District Manager. The contract rae <br />executed for a period of tro (2> years Eros this date. Therefore, the <br />expiration date of the contract rae established as being on February 3, <br />1982. The contract rae for 19,230 cubic yards of gravel at 60.26 per <br />cubic yard for a total contract price of 64,999.80. Attached to the <br />contract fors (3600-5) rae 'Exhibit A• STANDARD PROVISIONS and 'Exhibit <br />B• Operating and Reclawation Plan for the Disappointwent Gravel Pit, CO- <br />030-MPO-1. <br />At the tiwe of your signing of the contract, you paid tro (2) <br />installwent paywenta of 6500.00 each for a total of 61,000.00. On the <br />basis of 60.26 per cubic yard, this entitled you to rewove a waxiwuw of <br />3,846 cubic yards of weterial under this contract. Receipt and <br />accounting advice for^ 1370-1 (No. A152242) reflects this paywent as <br />being paid on February 4, 1980. <br />On March 3, 1980, the Montrose District Office received a letter Eros <br />Gerald D. Sjaestad enclosing a copy of the Public Notice in the <br />February 20, 1980, issue of The Denver Post concerning your application <br />filing rich the Colorado Mined Lend Reclawation Division. <br />Our records shot that cowpliance exawinations rare conducted an <br />February 12, 20, 25; April 16 (cultural); May 3; and July 18, 1980. The <br />only thing of special note in any of these exawinetions is that the <br />crusher had been rewoved fro^ the site by the July 18 exawination. <br />On February 3, 1982, the contract expired. No extension of tiwe had <br />been requested ae alloyed in Section 20 of the STANDARD PROVISIONS. <br />Therefore, in accordance rith Section 19 and 20(b) of the STANDARD <br />PROVISIONS, you had one (1) year Eros the terwination of the contract to <br />rewove any iaprovewents, personal property, or any wineral wateriale <br />previously severed or extracted for rhich paywent had been ^ade. In <br />accordance rith Section 20(b) of the STANDARD PROVISIONS, if severed or <br />extracted wineral materials for rhich paywent has been wade are not <br />removed rithin the one (1) year tiwe period, the title to such wineral <br />wateriale shall revert to the United States. This rae the case rith the <br />stockpile of gravel weterial left on the eouthrest end of the perwit <br />Brea. <br />
