Staff Recommendation <br /> Docket VSU-81-10 <br /> November 13, 1981 <br /> Page 14 <br /> Irrigation Water <br /> The applicants have provided evidence of ownership of 30.2 shares of <br /> Dry Creek No. 2 Ditch with an average yield of 165 acre-feet per year. <br /> This should be more than sufficient for irrigation to establish vegetation <br /> on reclaimed areas. As lakes are created, irrigation water will need to <br /> be removed from use on the property to offset increases in consumptive <br /> use due to evaporative losses. This will be offest by the fact that the <br /> areas covered by lakes will not require irrigation. <br /> Property Values and ecial Use Standards <br /> Some of the resi entsS of areas west of the proposed mining operation have <br /> indicated that an indexing system for property values should be established <br /> and that the applicant should compensate property owners for reduced <br /> property owners. This is one of the conditions submitted by the Greater <br /> Majestic Heights Neighborhood Association Task Force. In staff's opinion, <br /> the preservation of property values is one of the basic goals of planning <br /> and zoning concepts. If, based on the information, studies and testimony <br /> received, the Planning Commission and/or the Board of County Commissioners <br /> feels that the proposed activities will have a significant negative impact <br /> on property values in the area due to adverse impacts of the operations, <br /> the Special Use should not be approved. If, on the other hand, it is felt <br /> that the proposed operations can be tailored so as to not have significant <br /> adverse impacts, the Special Use should be conditionally approved. <br /> Staff feels that with certain conditions , the application can be tailored <br /> to meet the nine (9) standards listed under Section 15 of the Zoning <br /> Resolution, including being in harmony and compatible with the surrounding <br /> area, consistent with the comprehensive plan, not resulting in an over- <br /> intensive use of land, not having a material adverse effect on community <br /> capital improvement programs, not requiring a level of community services <br /> greater than that which is available, not resulting in undue traffic <br /> congestion or traffic hazards, not causing significant air, water or noise <br /> pollution, being adequately buffered, landscaped and screened, and not <br /> otherwise being detrimental to the health, safety or welfare of the present <br /> or future inhabitants of Boulder County. <br /> The following recommendation lists many conditions, many of which the <br /> applicant may agree to or may have intended to comply with as a matter <br /> of course. Due to the limited time available, staff did not have time to <br /> discuss all of the recommended conditions with the applicant. If the <br /> applicant agrees in writing to any of the conditions prior to the time <br /> of review by the Board of County Commissioners, the agreed upon conditions <br /> will be dropped from the formal staff recommendation and simply included <br /> in the file for future monitoring purposes. <br /> RECOMMENDATION: <br /> Staff finds that with certain conditions the application meets the requirements <br /> of the Bylaws for Use by Special Review, the Development Criteria for <br /> Sand and Gravel Mining Operations and can be in compliance with the nine (9) <br /> stnadards for Use by Special Review and recommends that the Planning Com- <br /> mission recommend to the Board of County Commissioners CONDITIONAL APPROVAL, <br />
