As mentioned above: as 'before any new areas are disturbed' in Stipulation 5 was not activated. <br />No as-built drawings and narrative could not be found, if created. <br />Stipulations #2 and # 4 relating to Phase 2 (II) and 3 (111) are moot as Phase 2 (II) and 3 (III) were <br />never started. Since they never started then no new areas were disturbed and no mention of <br />activates were reported in the annual reports could be found <br />Attached is correspondence from Mr. Allen Sorenson dated March 28. 1994. It mentions a <br />'Geotechnical Engineering Report' was submitted to the State of Colorado for load-out benches. <br />Therefore Holcim US Inc. appears to have complied with this portion of Stipulation 5. I could not <br />find Holcim's copy of the Geotechnical Engineenng Report. <br />Conclusion <br />Holcim US Inc. is wmmitted to the State of Colorado's ReGamation Regulations. <br />The last Minerals Program Inspection Report on Slab Canyon Quarry dated 3/13/02 showed all <br />areas in compliance (attached). <br />It is our hope that this letter will satisfy your May 12, 2004 request for evidence that the <br />stipulations are in compliance as of today and that their status is documented <br />Holcim absolutely does not want to trip enforcement actions for non-compliance. Please let us <br />know is further work is required. <br />We appreciate all your efforts.
