Stipulation 3 as both parties can not find the <br />correspondence but in fact the growth medium <br />does exist in amounts necessary for reclamation <br />In and as fad; growth medium does exist on the <br />existing penn~tted area m volumes to complete <br />reclamation of Phase I, Approximately +148.000 <br />cubic yards of growth medium is available for <br />reclamation. <br />It is unknown at this time if there was a Bond increase relating to Stipulation #3. <br />Stipulation #4 -May 3, 1994 <br />"Before disturbing any paA of Phase 2 or 3, operator will submd to the Division the minimum <br />amount of growth medium (Speci/ied amounts of sandy overburden fines and available topsoil) <br />required Ior reclamation of that Phase (2 and 3). This material; will be stockpiled in the <br />designated areas on-site until it is used for reclamafiion activdies. Attematively, the operator can <br />post the necessary bond for hauling sufficient matenal in from oH--site. " <br />Evidence for Stipulation 3 -July 12, 2004 <br />Note: Phase 2 (II) and 3 (III) were never started and therefore Stipulation #4 is moot. <br />It is unknown at this time if there was a Bond increase relating to Stipulation #41 <br />Stipulation #5 -May 3, 1994 <br />"The operator will commit to conditions 1 through 4, as outlined in the 3/2t~/94 memo (attached) <br />regarding the load-out benches by Mr. Allen Sorenson, before anv new areas are disturbed. <br />Operator will provide as-built drawings end narrative, pertinent to the conditions mentioned <br />above, in the annual reports fw the Slab Canyon Quarry during each year that load-out benches <br />are constructed." <br />Evidence for Stipulation 5 -July 12, 2004 <br />Holcim assumes that 'condtions 1 through 4' in Stipulation #5 means Stipulations 1 through 4 <br />Please note that there is no evidence that any 'load-out benches' were ever constructed at Slab <br />Canyon Quarry. <br />I could not fmd any load-out conditions in Stipulations 1 through 4 <br />
