Sur- veying of *_hese stations shall he repeated on a szmi-annual basis far a period of t:vo years. Results of the surveying of these stations shall be submitted to the Regulatory Authority ~dithin 30 days following completion of the semi- annual surrey. If monitoring of the backfiTled area de*_ects movemerrt, which the Regulatory ,authority determines to represent an indication of imminent hazard, the Bear Coal Company shall expeditiously develop and implement, fal- lowing the Regulatory Authority's approval, a plan to mitigate that hazard and to stdbllZ2 the backfilled areas. 8. The Regulatory Authority direC.s Bear Coal Company to perforn Proctor testing *_c determine the moisture-density relations of the materials to be utilized in backfilling the Bear Yo. 1 and Plo. 2 mine portal areas and submit the result to the Regulatory Authority. In conformance with the recommenda- tions of Rocky t4ountain Geotechnical, Inc., the materials shall be placed and compacted to achieve 46X of the maximum proctor density, as determined in accordant= with ASTId standard TES 0-048. Further, Bear Coal Compacry shall submit a certified inspection report to verify completion of backfilling and grading of the Bear ~Ja. 1 and Yo. 2 mine portal areas in conformance with the approved plan. This ~rti-""led report shall be prepared by a qualified regis- ^ tired professional engineer or professional geologist. The report shall be submitted to the Regulatory Authority ~nithirt 60 days of `tte gmpleticn of backfilling and grading. 4. The Regulatory Authority directs Sear Caal Company to submit a detailed engineering plan fer the portal access road and portal facilities at the gear yo. 3 Mine, for revied and approval by the Regulatory Authority, rro later than 30 days fallowing approval of the permanent program permit. This detailed engineering plan shall include road and portal crass-sections, road and portal plan and grade design drawings, and detailed engineering design drawings for all retaining structures and drainaee facilities.
