Stream Buffer Zones <br />The Division proposes to approve surface or underground <br />mining activities within 100 feet or through a perennial <br />stream or stream with a biological community. This decision <br />is based on a finding that the original stream channel will <br />be restored, water quality and quantity shall not be <br />adversely affected, and appropriate riparian vegetation will <br />be reestablished. The buffer zone variance is granted for <br />the area located on haul roads between Pits 1 and 2 and <br />between Pits 2 and 3. (4.05.18(1)). <br />II. TOpsOil <br />The Division has determined that the B horizon and portions of the <br />C horizon shall be segregated and replaced as subsoil in order to <br />ensure soil productivity consistent with the approved post-mining <br />land use [4.06.2(3)]. Subsoils from Pit 3 will ne placed on Pits <br />and 2 prior to topsoil placement to ensure adequate depths of <br />non-sodic plant growth medium. <br />The Division has determined selected overburden materials shall be <br />used for, or as a supplement to topsoil. The resulting soil is <br />equal to or better than the available topsoil. This determination <br />is based on physical and chemical analyses approved by the <br />Division. (4.06.2(4)(a)). <br />III. Sealing of Drilled Holes and Underground Openings <br />The Division will require that each hole, well or other underground <br />opening be capped, sealed, backfilled, or otherwise properly <br />managed. (4.07.3). <br />IV. Use of Explosives <br />The Division proposes to approve blasting at times other than those <br />described in the blasting schedule due to unavoidable hazardous <br />situations. (4.08.3(2)(b)(v) and (4.08.4(2)). <br />V. Backfillinq and Grading <br />The applicant has requested additional time for backfilling and <br />grading following coal removal. A detailed written analysis under <br />2.05.4(2)(c) has demonstrated that additional time is necessary. <br />Therefore, the Division proposes to approve the additional time. <br />(4.14.1) <br />
