6. When the access route is no longer needed or upon termination of this <br />agreement, whichever is sooner, User shall make a final inspection of <br />tiie access route and notify EEC that all necessary reclamation work <br />has been completed in accordance with this agreement. Thereafter, <br />User agrees to have a representative available at reasonable times to <br />inspect the access route with a representative of EEC for the purpose <br />of determining whether such reclamation work fully complies with the <br />requirements of this agreement. <br />7. EEC shall have the right, exercisable at all re~~sonable times and in <br />a reasonable manner so as not to interfere with User's operations, to <br />use the access route for the purpose of observing User's operations. <br />8. User will reclaim the access route in accordancE aiith all applicable <br />federal and state reclamation requirements; and will furnish a copy <br />of such reclamation requirements to EEC. ~' <br />9. Whether or not User allows contractors to;' use access route, User <br />agrees that it will be fully and solely responsible to EEC for use of <br />access route in accordance with the requirements as set forth in this <br />agreement, and User agrees to indemnify and hold harmless EEC, its <br />employees, agents, consultants and contractors, and employees and <br />agents of such contractors, from all damage; to persons and property <br />resulting from the presence, activities, and operations of User, its <br />employees, agents, consultants, contractors and employees of <br />contractors, on the access route. <br />
