_.~ 2. User will notify EEC as to the name of each contractor hired by User <br />to use access route and the name of each 'employee of User tvho will <br />supervise or inspect such operations. User agrees to notify EEC in <br />writing when the use of the access route is no longer needed. <br />3. User, and all persons authorized to use access route, agree to use <br />the access route which is marked on Exhibit A. The access route will <br />be used in accordance with all applicable federal and state laws, <br />rules and regulations. User will be responsible for securing <br />i <br />permission to use access route from the MLR~I. <br />~; <br />4. User agrees to maintain the access route in a~good and workmanlike <br />manner. User shall not use the access rote i~F the ground is soft <br />and excessive rutting, in excess of three inches, would be caused by <br />vehicular movement. User shall not cause any unnecessary damage to <br />the access route and shall not create any h~~zards to persons or <br />livestock. User shall take all precautions necessary to avoid damage <br />to gates and fences. User shall promptly repair any damage to the <br />condition existing prior to its use of acce:,s route. <br />5. User shall keep the title to the access rou.:e free and clear of liens <br />and encumbrances resulting from its operations hereunder, provided <br />that User may refuse to pay 'any claims asserted against it which it <br />disputes in good faith. User shall contest any action commenced to <br />enforce such a claim, and, if the action ~~s finally decided against <br />User, User shall promptly pay such claim if required by the final <br />judgement. <br />
