The applicant shall refrain from operating the site on Sundays; no processing of <br />rnateri~ils, including crushing and screening, shall occur on weekends; and the <br />aipplicarit shall limit the operation ofthe site (including extraction, processing and <br />ltaulinb i to the time between sunrise and sunset; <br />4. The applicant shall file a copy of their Annual Mined Land Reclamation Report with <br />the Department of Planning and Development at the time it is submitted to the State <br />of Colorado, Department of Natural Resources, Mined Land Reclamation Division. <br />`i. 'The applicant shall develop, operate, and manage the mining-related activity <br />according to the rules, regulations, plans and permits administered by the <br />applicable federal, state, and local agencies. Any violation of a rule, regulation, <br />permit, or plan may result in the scheduling of aShow/Cause Hearing to consider <br />the revocation of Special Use Permit No. 1998-041. <br />G. The Department of Planning and Development is directed to conduct an <br />administrative inspection of the property on or before January 1, 2000. If the use <br />authorized by this Special Use Permit has been established, and if the property is <br />found to be in compliance with the Pueblo County Zoning Resolution and all other <br />requirements outlined in this report, the permit will be placed on a complaint basis <br />only. ]f the property is NOT in complia<ice, the permit shall be scheduled for the <br />January, 2000, Pueblo County Planning Commission meeting for a one year review. <br />7. The applicant shall apply for new access permits for their proposed access points. All <br />conditions associated with said permits shall be complied with and construction <br />completed prior to commencing operation of the pit. An approved access permit(s) <br />shall be deemed as compliance with this condition. <br />8. The haul route from the Cesar Pit s1ta11 be limited to the south. No hauling shall be <br />done on St. Charles Road to the north beyond the most easterly approved access point <br />of the pit. <br />9. Prior to commencing the gravel operation the applicant shall place a hash mark at the <br />side of the haul route at tenth (0.10) of a mile intervals starting at the applicant's point <br />of access to St. Charles Road. Each mark shall bear the appropriate tenth (0.10) of a <br />mile reading beginning at the applicant's access point (e.g. 0.1 at the first mark, 0.2 at <br />the second, and so on). The applicant shall then video tape the haul route, at the <br />applicant's expense. The videotape shall be produced in standard VHS format in <br />such si way and at such a speed that any defects in the roadway surface shall be easily <br />discernable for viewers. This will be the established baseline for repair requirements. <br />Upon completion of all mining related activities under this SUP or every six (6) <br />months (during mining activity only), whichever is less, the applicant shall repeat this <br />process. A copy of this videolog will be submitted to Public Works prior to <br />commencing operation of this pit. The time frame between video taping can be <br />extended at the discretion of the Pueblo County Public Works Director. <br />
