-~- <br />Section 3.29 The Recipient shall treat program income in <br />accordance with the Grants Management Common <br />Rule, adopted by the Department of Interior at <br />43 CFR 12. Program income includes, but is not <br />limited to, income from the sale of <br />publications, the sale of real or personal <br />property purchased with grant funds, the sale of <br />services under a grant (such as the sale of <br />computer time), permit fees, income earned from <br />investment of permit fees and other program <br />income,and income from royalties received as a <br />result of copyrights or patents produced under <br />the Cooperative Agreement. Program income does <br />not include income from fines, penalties, taxes <br />or forfeitures. Program income will be deducted <br />from the total cooperative agreement costs for <br />the purpose of determining the net costs on <br />which the Federal share of costs will be based <br />(deductive option). <br />Section 3.29 The Recipient shall give reasonable notice to <br />the OSM Project Officer in writing of the final <br />inspection of the project. The OSM Project <br />Officer or his representative may inspect the <br />project site any time after having given <br />reasonable notice to the Recipient. <br />Section 3.30 The Recipient is free to copyright any original <br />work developed in the course of or under this <br />Agreement. OSM reserves a royalty-free, <br />nonexclusive and irrevocable right to reproduce, <br />publish or otherwise use, and to authorize <br />others to use the work for Government purposes. <br />Any publication resulting from work performed <br />under the agreement shall include an <br />acknowledgement of OSM financial support and a <br />statement that the publication does not <br />necessarily reflect OSM's views. <br />ARTICLE IV. PAYMENTS <br />This Cooperative Agreement shall be funded by using the OSM Letter-of- <br />Credit (IAC) that was established by the Department of the Interior, O5:•!, <br />against which the Recipient will withdraw funds pursuant to the prescric~~ <br />Treasury Circular 1075 (31 CFR Part 2051. By acceptance of this <br />Cooperative Agreement, the Recipient is committed to drawing Federal f•.:~_ <br />only at the time actually needed to make disbursement and submitting <br />timely reports as required Article V. The Recipient is authorized to ~:~.. <br />Federal funds to meet the Federal share of current disbursing needs b'; <br />presentation of the Request for Payment of the LOC and Status of Funds <br />
