<br />XVII. Roads - Rules 2.05.3(3) and 4.03 <br />Information on roads can be found in Chapter C, Volume I of the permit <br />application. There are no changes to this part of the operation and the roads <br />are to remain in place pursuant to landowner request. <br />Two stipulations (16, 17) were satisfied and are no longer required, <br />The proposed operation is in compliance with the requirements of this rule. <br />XVIII, Subsidence - Rules 2.05.6(6) and 4,20 <br />Information on subsidence can be found in Chapter 5, Volume VII of the permit <br />application. The only monitoring performed and currently being performed was <br />to check and monitor backfilled slopes at the two portals. No appreciable <br />subsidence has occurred to date. <br />The proposed operation is in compliance with the requirements of this section. <br />XIX. Bonding (Rules 2,05,4(2)(b) and Rule 3) <br />The mine currently has E301,000.00 of bond on file with the Division, This <br />amount will be adequate to perform the remaining reclamation should the <br />Division need to undertake it during this five year permit term, <br />The operation is in compliance with the requirements of this section, <br />XX. Sealing of Drilled Holes and Underground Openings - <br />Rules 2,05.4(2)(8) and 4,07 <br />All drill holes and underground openings have been properly sealed and to date <br />have shown no sign of leaking or subsiding. Stipulation 19 which requested <br />plans to show how the portals would be hydraulically sealed has been satisfied. <br />The operation is in compliance with the requirements of this section. <br />XXI. Special Categories of Mining -Rules 2.06, 4,22, 4,23, 4,26, 4,21, <br />4.28, 4.29 <br />The applicant does not currently operate or propose any operations contained <br />within the noted categories of; concurrent surface and underground mining, <br />auger mining, mountain top removal, steep slope mining, or in-situ processing. <br />The operation is in compliance with the requirements of this section. <br />XXII, Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, and <br />4.21 <br />No problems were identified with respect to the requirements of these <br />sections; signs and markers, surface coal mining near underground mining, <br />slides and other damage, protection of underground mining, coal exploration, <br />and cessation of operations. <br />The proposed operation is in compliance with the requirements of this section. <br />-12- <br />
