.. <br />-~ XIII. Fish and Wildlife - Rules 2.04,11, 2.05.6(2), and 4.18 <br />Fish and wildlife baseline information can be found in Chapter L of Volume YII <br />of the permit application. Plans for mitigation of impacts to fish and <br />wildlife can be found in Chapter 0 of Volume VI. <br />Pursuant to Rule 2.07.6(2)(n) and on the basis of available information, the <br />Division finds that the proposed operations will not affect the continued <br />existence of threatened or endangered wildlife species or result in the <br />destruction or adverse modification of their critical habitats. <br />The Division finds the proposed operation in compliance with the requirements <br />of this section. <br />XIY. Prime Farmlands - Rules 2.04.12, 2.06.6, and 4.25 <br />The Division has made a negative determination on the presence of prime <br />farmlands within the proposed permit area. The decision was based on the <br />evidence provided by the Soil Conservation Service that there are no soil <br />mapping units within the proposed permit area that have been designated prime <br />farmlands. <br />The Division therefore finds the proposed operation in compliance with <br />Rule 2.07.6(2)(k) with respect to prime farmlands. <br />XV. Operations Description -Rules 2.05.5, 2.05.3(1), 2.05.3(2), and 4.01 <br />Information on the operation plan for the Meeker Area Mines can be found in <br />Chapter C of volume I of the permit application. <br />At this time the Division has approved reclamation operations at the mine <br />site. There was one stipulation (15) which required Enron to complete <br />reclamation at the Northern No. 1 site within two years of permit issuance, <br />This was accomplished and the stipulation is no longer necessary. <br />The operation is in compliance with the requirements of this section. <br />XVI. Backfilling and Grading (Rules 2.05.3(b), 2.05.3(9), 2.05.4(2)(a <br />~~ <br />The entire disturbed area has been backfilled and graded where required. <br />In order to insure the integrity of these reclaimed slopes the Division <br />imposed Stipulation 14 which required a certified engineers report, a <br />post-mining contour map, and submittal of an annual monitoring report. The <br />initial requirements of the stipulation were met. <br />The mine is now inactive, and no further mining is proposed. The permittee <br />has reclaimed the site and is submitting the required annual report. <br />The operation is in compliance with the requirements of this section. <br />_11_ <br />
