Operations on Lands <br />Ru es 2. 3. and 2 <br /> <br />ject to Limitations of Prohibitions - <br />Pursuant to 2.07.6(2)(d), the Division finds that the proposed permit area is <br />not included within an area designated unsuitable for mining, and is not <br />within an area under study for designation as unsuitable for mining. The <br />Division further finds that with one exception the proposed operation is not <br />located on any lands subject to the limitations or prohibitions of <br />2.07.6(2)(ci)(iii). That is, the proposed permit area is not on any lands <br />within the boundaries of the National Park System, the National Wildlife <br />Refuge System, the National System of Trails, the National Wilderness <br />Preservation System, or the Wild and Scenic Rivers System or rivers designated <br />for study for inclusion in that system. <br />The proposed permit area is not; within 300 horizontal feet of any public <br />building, school, church, community or institutional building, or public park; <br />within 100 horizontal feet of any cemetery; within the boundaries of any <br />national forest. As defined by C.R.S. 34-33-103(26), surface coal mining <br />operations will not be occurring closer than 300 horizontal feet to an <br />occupied dwelling. <br />The operations are within 100 horizontal feet of the outside right-of-way of a <br />public road (State Highway 13/789). However, the operations were in existence <br />prior to August 3, 1911, therefore exempting the applicant from the <br />requirements of Rule 2.07.6(2)(d)(iv). <br />XXIV. Demonstration that Surface Coal Mining and Reclamation Operations <br />can be Feasibly Accomplished (Rule 2.07.6(2)(b)) <br />Based on successful reclamation by other operations in the area pursuant to <br />Rule 2.07.6(2)(b), the Division hereby makes the finding that the applicant <br />can feasibly accomplish reclamation at the Meeker Area Mines. <br />XXV. Compatibility with Anticipated Adjacent Operations - <br />The proposed operation is not inconsistent with any anticipated surface coal <br />mining operations adjacent to the proposed permit area, as determined by the <br />Division. There are no anticipated surface coal mining activities adjacent to <br />the operation. <br />The proposed operation is in compliance with the requirements of this section. <br />/WW/ern <br />5884F <br />-13- <br /> <br />
