IF THE <br />COMPLIANCE WITH RULE 4.03.2)4)(e) <br />SUBMIT A PLAN TO BRING THE ROADS <br />VARIANCE FROM THE CULVERT SPACING <br />RULE 4.03.2(1)(e). <br />ROAD CULVERT SPACING REQUIREMENTS <br />PRESENT CULVERT SPACING IS NOT IN <br />(v), THE PERMITTEE MUST EITHER <br />INTO COMPLIANCE OR REQUEST A <br />REQUIREMENTS IN ACCORDANCE WITH <br />THIS INFORMATION WILL BE SUBMITTED AS A REVISION TO THE PERMIT. <br />The applicant has not submitted a definitive reclamation plan for the roads at <br />the Allen Mine. The current post-mining topography map, map No. 15, indicates <br />that the two access road crossings of the Purgatoire River are to be retained <br />and the road embankment of the main east-west access road which blocks several <br />small drainages is to remain. Rule 4.03.2(7)(a) requires that all bridges and <br />culverts be removed and natural drainage patterns restored. Therefore the <br />existing road reclamation plan is unacceptable and the following stipulation <br />is required: <br />Stipulation No. 29: <br />THE PERMITTEE MUST SUBMIT, AS A REVISION, A RECLAMATION PLAN FUR ROADS <br />AT THE ALLEN MINE THAT MEETS THE REQUIREMENTS OF RULES 4.03.2(7) AND <br />4.03.3(7) WITHIN 12 MONTHS OF PERMIT ISSUANCE. <br />With satisfactory resolution of the above stipulation, the proposed operation <br />will be in compliance with the requirements of this section. <br />XXI. Bonding - Rule 2.05.4(2)(b) <br />Bonding calculations were submitted by the applicant on December 6, 1983. <br />These calculations were reviewed by the Division and revised to include the <br />cost associated with placement of four feet of cover on the approved refuse <br />piles. Removal costs for the railroad track were increased by $105,582.00 in <br />accordance with removal costs in Means Building Construction Cost Data 1983. <br />Revegetation casts were increased to $635.00 per acre after a detailed cost <br />breakdown. The salvage value credit of $80,553.00 was added back in. <br />The Division has, therefore, calculated the bond for this five-year permit <br />term to be $1,402,000.00. <br />XXII. Sealing of Drilled Holes and Underground Openings - Rul <br />Information on sealing of drilled holes and mine openings can be found in <br />Volume I, pages 2.05-34 through 2.05-37 and in the Draft Findings response <br />submitted December 20, 1982. <br />This information has been reviewed for compliance. The proposed operation <br />will be in compliance with the requirements of this section. <br />
