<br /> <br />-58- <br />With the acceptance by the applicant of the above stipulation, the Division <br />finds the proposed operation is in compliance with the requirements of this <br />section. <br />XIX. Mine Facilities, Coal Handling Structures, Support Facilities - <br />Information on mine facilities can be found in Volume I of the application <br />pages 2.05-7 through 2.05-12, coal handling structures is dealt with on pages <br />2.05-6 and 2.05-26. <br />The proposed operation is in compliance with the requirements of this section. <br />XX. Roads - Rules 2.05.3(3)(c)(i) and 4.03 <br />The application section dealing with road design and drainage for the <br />operation is on page 2.05-10 in Volume I, exhibit 16 in Volume II, and Maps <br />12A-C and 13A-C in Volume IV of the application. <br />Roads addressed in the permit application include two access roads from the <br />highway to the .mine, an access road from the east to the west ends of the <br />disturbed area, several light use roads to water tanks, pipes, and other <br />facilities, and a light use road to the Apache Canyon air intake shafts. <br />The applicant supplied very little information on road drainage. The only <br />roads for which information was given are those within the disturbed area. <br />However, the Division is aware of several culverts which are located within <br />the disturbed area for which no information was given. In order to make a <br />finding of compliance in accordance with Rule 4.03, the following stipulation <br />is necessary. <br />Stipulation No. 28: <br />WITHIN 60 DAYS OF PERMIT ISSUANCE, THE PERMITTEE MUST SUBMIT A <br />NARRATIVE, MAPS, PLANS, AND SUPPORTING CALCULATIONS TO PROVE THE ACCESS <br />ROADS AND LIGHT-USE ROADS ARE IN COMPLIANCE WITH THE REQUIREMENTS OF <br />RULE 4.03. THIS PLAN MUST INCLUDE AT A MINIMUM: <br />A. A NARRATIVE, PLANS, AND SUPPORTING CALCULATIONS PROVING THAT ALL <br />ACCESS AND LIGHT USE ROAD DRAINAGE DITCHES AND CULVERTS ARE SIZED <br />TO PASS THE PEAK FLOW FROM A 10 YEAR, 24 HOUR PRECIPITATION EVENT. <br />B. A MAP OR MAPS SHOWING THE LOCATION OF ALL ROAD CULVERTS, STREAM <br />FORDS, AND BRIDGES. <br />C. EITHER A PLAN TO BRING THE APACHE CANYON STREAM FORDS INTO <br />COMPLIANCE, OR A REQUEST FOR A VARIANCE FROM INSTALLING CULVERTS IN <br />ACCORDANCE WITH RULE 4.03.3(2)(c). <br />
