<br />-60- <br />XXIII. Subsidence -Rules 2.05.6(6) and 4.20 <br />Information on subsidence and a subsidence control and subsidence monitoring <br />plan can be found in Volume I, pages 2.05-45 through 2.05-48, Volume II, <br />Exhibit 21, and Volume IV, Maps 17 and 18. These sections of the application <br />have been reviewed by the Division for compliance with the Regulations. <br />The applicant has failed to present adequate hydrologic infornation concerning <br />the renewable resource land designation of alluvial aquifer areas within <br />Apache Canyon, and Left Fork of Apache Canyon. As discussed in Section V, <br />"Hydrologic Balance: Surface Water" and Section VI, "Hydrologic Balance: <br />Ground Water", the applicant must provide sufficient information to <br />demonstrate that the proposed secondary or retreat mining plan will prevent <br />material damage to the affected renewable resource lands. THESE ANALYTICAL CALCULATIONS, PREPARED IN ACCORDANCE WITH <br />AN ANALYTICAL METHOD ACCEPTABLE TO THE DIVISION, SHALL BE SUBMITTED TO <br />THE DIVISION FOR REVIEW WITHIN 60 DAYS FOLLOWING PERMIT ISSUANCE. <br />Four structures, an overhead powerline, a railroad spur, a buried telephone <br />cable, and the Purgatoire River and it's associated alluvial aquifer, exist <br />within the permit area. The applicant will visually monitor these structures <br />to discern potential effects of subsidence on a quarterly basis. Visual <br />monitoring will be performed along those portions of the structures that lie <br />within the areas defined by an angle of draw of 300 (measured from <br />vertical), projected from the coal seam to the ground surface. <br />With the acceptance of the above stipulation, the proposed operation is found <br />to be in compliance with the requirements of Rules 2.05.6(6) and 4.20. <br />XXIV. Special Categories of Mini <br />The requirements of this section do not apply to this operation, since none of <br />the special categories of mining will be conducted. <br />XXV. Miscellaneous Compliance - Rules 2.05.6(5), 4.02, 4.12, 4.19, 4.21, 4.28 <br />~~3 <br />No problems were identified with respect to the requirements of these sections <br />during the review. Based on information provided in Vol. I of the <br />application, the operation is in compliance with all the requirements of the <br />above sections. <br />
