Section I - Historv
On May 13, 1991, the Pittsburg & Midway Coal Mining Company submitted an application to
renew the valid, existing permit for surface mining operations at the Edna Mine. The application
was approved with conditions on September 12, 1992. The five year permit term was renewed
effective November 16, 1991, and will expire on November 16, 1996.
Mining operations continue in the Moffat pits, and final grading is underway in the West Ridge
area. Check dam construction associated with the West Ridge hydrologic reconstruction plan
(Permit Revision No. 2) is progressing on schedule. Terrace construction will likely commence
this construction season, with completion of the reconstruction projected for October 1995. The
revamped Goat Trail access road drainage plan was implemented in the Fall of 1993. A
redesigned upper facilities area drainage plan, including a new sediment pond, is scheduled for
implementation this summer.
P&M submitted an application for a permit revision (Permit Revision No. 3) to the Edna Mine
plan on November 13, 1992. The revision included plans to declassify a portion of Oak Creek
as an alluvial valley floor, and to retain the Center Ridge and West Ridge ponds on a permanent
basis. A proposed decision to approve the application, with conditions, was issued on May 16,
1994.
Five enforcement actions were taken since the permit was renewed. All five were notices of
violation, two of which were subsequently vacated by the Colorado Mined Land Reclamation
Board. A description of the three upheld notices and their status follows:
Notice of Violation C-93-024
Issued April 5, 1993.
The nature of the violation was:
"Failure to ensure that the construction and maintenance of access roads into and
across the site of operations will control or prevent erosion and siltation, pollution
of water, or damage to public or private property."
The violation existed on the Goat Trail access road.
The operator was fined $1000.00.
The violation was abated and the notice terminated after the operator redesigned and
implemented the Goat Trail drainage plan (Technical Revision 24).
Notice of Violation C-93-025
Issued April 5, 1993.
Edna Mine (C-80-001) May IB, I994
Midtcnn Review 2 Third Pcrmit Tcmr
