Section I - Historv <br />On May 13, 1991, the Pittsburg & Midway Coal Mining Company submitted an application to <br />renew the valid, existing permit for surface mining operations at the Edna Mine. The application <br />was approved with conditions on September 12, 1992. The five year permit term was renewed <br />effective November 16, 1991, and will expire on November 16, 1996. <br />Mining operations continue in the Moffat pits, and final grading is underway in the West Ridge <br />area. Check dam construction associated with the West Ridge hydrologic reconstruction plan <br />(Permit Revision No. 2) is progressing on schedule. Terrace construction will likely commence <br />this construction season, with completion of the reconstruction projected for October 1995. The <br />revamped Goat Trail access road drainage plan was implemented in the Fall of 1993. A <br />redesigned upper facilities area drainage plan, including a new sediment pond, is scheduled for <br />implementation this summer. <br />P&M submitted an application for a permit revision (Permit Revision No. 3) to the Edna Mine <br />plan on November 13, 1992. The revision included plans to declassify a portion of Oak Creek <br />as an alluvial valley floor, and to retain the Center Ridge and West Ridge ponds on a permanent <br />basis. A proposed decision to approve the application, with conditions, was issued on May 16, <br />1994. <br />Five enforcement actions were taken since the permit was renewed. All five were notices of <br />violation, two of which were subsequently vacated by the Colorado Mined Land Reclamation <br />Board. A description of the three upheld notices and their status follows: <br />Notice of Violation C-93-024 <br />Issued April 5, 1993. <br />The nature of the violation was: <br />"Failure to ensure that the construction and maintenance of access roads into and <br />across the site of operations will control or prevent erosion and siltation, pollution <br />of water, or damage to public or private property." <br />The violation existed on the Goat Trail access road. <br />The operator was fined $1000.00. <br />The violation was abated and the notice terminated after the operator redesigned and <br />implemented the Goat Trail drainage plan (Technical Revision 24). <br />Notice of Violation C-93-025 <br />Issued April 5, 1993. <br />Edna Mine (C-80-001) May IB, I994 <br />Midtcnn Review 2 Third Pcrmit Tcmr <br />
