Special Use Permit No. 570 be placed on a one-year <br />review. <br />COMMENTS <br />Current Status of Conditions <br />~~ 1. Mined Land Reclamation Permit <br />On April 14, 1986, a 112 permit (M-85-218) was issued to the <br />applicant. The proposed affected area under that permit is <br />89 acres. However, the acreage described in the SUP totals <br />approximately 79 acres (75 acres associated with the pit, 2.3 <br />acres associated with the new haul road, and 1.38 acres <br />associated with the plant site). Staff is unsure as to where <br />the difference is, but the applicant may disturb no more than <br />is permitted under the SUP. A copy of the MLRB permit was <br />submitted to staff on January 22, 1987. <br />2. Fugitive Dust Permit <br />Emissions Permit No. 86-PB042-(2)F, a point source permit for <br />the crushing operation, and Emissions Permit No. 86-PB042(1), <br />a permit for the batch plant, were issued an initial approval <br />on June 12, 1986. Emmett Hance (staff, Pueblo City-County <br />Health Department) inspected the property in August, 1986 and <br />recommended final approval for both permits. <br />3. 404 and/or 401 Permit <br />To date the water course of the Arkansas River has not been <br />altered by activities under SUP No. 570. The applicant's <br />MLRB permit contains an agreement to maintain a "minimum <br />totally undisturbed setback of 100"' between the banks of any <br />perennial stream and all mining operations. Because of that <br />agreement, a 404 or 401 permit may never become necessary. <br />
