Response: Names are provided for the vent holes and related features that are part of the <br />modern operations of the Sunday complex of mines. The PreLaw vent holes have not been <br />named on the enclosed maps as no names or designations have been found for these holes. <br />Unidentified vent hole and surface facility: Two vent holes and associated electric power <br />features and roads were discovered during the 12/18/01 inspection. These features are not shown <br />on any maps and are not included under any of the permitted sites. The Operator must include <br />these installations under one of its Permits. <br />Response: The features noted in the 12/18/01 inspection are the "SJ-1" vent hole, its <br />transformers installation, a nearby compressor station, and associated short segments of access <br />road. Clearly this installation is not "PreLaw". The Operator has not been able to find any <br />evidence that the installation was permitted by previous operators, and the installation appears to <br />be an "orphan" that is not specifically assigned to an existing Permit. Figure 2 submitted <br />herewith shows the location of the SJ-1, but it is not specifically included in the Sunday Mine <br />vent holes. The SJ-1 site should be included with either the Sunday Mine Permit or the West <br />Sunday Mine Permit. Both of these 112 Permits can include acreage large enough to add the SJ- <br />1 site. As noted in this October 7, 2002 correspondence, adding the new site to the Sunday Mine <br />Permits might be the easiest as this Permit allows for the addition of unspecified remote sites. <br />However, the SJ-1 site is well outside the boundary of the Sunday Mine 112 Permit. The SJ-1 <br />site is closer to the West Sunday permitted vent holes and facilities, but the West Sunday 112 <br />boundary apparently does not cover this area either. <br />As noted in the October 7, 2002 letter, all of the individual mines comprising the Sunday <br />group of mines are in fact interconnected underground. The naming designation of the <br />individual permits is really a relict of past times and different mine ownerships and operators. <br />There is no distinction underground on whether the SJ-1 vent is associated with the Sunday Mine <br />Permit or the West Sunday Mine Permit. For purposes of this response and submittal package by <br />the Operator to the Division, the SJ-1 site is included under the West Sunday Permit, but this is <br />not intended to be a final or conclusive proposal by the Operator on the best way to resolve this <br />matter. <br />Cluster of vent holes and associated access roads: There are several vent holes, and their <br />associated roads and electrical structures, that do not have a disturbed area shown on the <br />PRELIMINARY map. Also the road into this cluster of vent holes does not match the road <br />configuration shown on past maps with the Division. An explanation of these discrepancies is <br />requested. <br />Response: As emphasized by the Operator, the PRELIMINARY maps are not intended <br />to be final and were working drags subject to final editing. To avoid confusion, the Operator <br />requests the PRELIMINARY maps be returned to the Operator upon receipt by the Division of <br />the new maps submitted herewith. <br />The active road into the S-l, S-6, S-7 vent hole cluster exits off the existing main access <br />road a short distance to the west of the vent holes. The are many roads and trails throughout the <br />area south of the main Sunday Mine, and the specific road noted in a past inspection does not <br />provide primary access into the vent hole cluster. The disturbance area around the three vent <br />holes has been surveyed and is shown on Figure 2. The primary access into the cluster of three <br />vent holes is also shown on Figure 2. <br />Use of different symbols to designate the status of roads: Roads which have been used under <br />permitted operations must be included in the estimation of disturbed area and must be reclaimed. <br />11 <br />
