Response: The Operator posted a new ID sign and provided photographic evidence to the <br />Division on January 29, 2002. Marking of Affected Area boundaries has not been conducted. <br />As noted by the inspector, there are a number of deficiencies in the maps for the Sunday Mine, <br />and therefore, boundaries cannot be marked until the Division and the Operator have resolved <br />outstanding questions on the features associated with the Sunday Mine. The Operator herewith <br />submits complete maps and descriptions of the Sunday Mine and ancillary features. The existing <br />maps on file for the Sunday Permit are outdated and do not reflect current site conditions. The <br />Operator is ready to mark the Affected Area boundary upon receiving affirmation from the <br />Division. <br />Access roads to remote sites are eroding and becoming impassable; lack of sediment control and <br />uncontrolled erosion are problems: The access roads to vent holes on the ridge above the Sunday <br />Mine are becoming severely eroded which could raise the cost of future reclamation. Sediment <br />control is not in practice on any of the roads or remote sites. The lack of sediment control and <br />uncontrolled erosion were classified as a "problem" by the inspector. A Corrective Action and <br />Correction Date were not specified. <br />Response: The Operator has inspected all sites and features associated with the Sunday <br />Mine Permit, and the report on site conditions is submitted herewith. The Operator conducted <br />site maintenance work in November 2002. <br />Diesel storage tanks without adequate containment: Two large diesel fuel storage tanks in the <br />Sunday yard lack acceptable spill containment; this was noted in past inspections. The tanks <br />each contain fuel but the amount is unknown. <br />Response: The subject tanks have never been used by the Operator. Both tanks are <br />empty and the valves from the tanks are open. The Operator understands and acknowledges that <br />neither of these tanks can be used in the future without providing for spill containment. <br />Weeds on site must be controlled by time of reclamation: No final reclamation seeding has been <br />conducted at the site. Halogeton must be under control by the time the site is to be reclaimed. <br />Response: No response. <br />March 15.2002 Inspection by Bob Oswald: <br />Inspection of one vent site: One vent hole site that was not located and inspected previously by <br />the inspector was found and observed. The site appeared neglected, though not unstable or <br />eroding. <br />Response: A description of site conditions and updated maps showing all features under <br />the Sunday Mine Permit are submitted herewith. <br />October 7, 2002 letter from Division: <br />This letter was written by the Division in response to PRELIMINARY maps that were <br />submitted by the Operator for general review. This letter poses a number of questions and <br />concerns. <br />Naming vent holes: There are numerous vent holes and related structures that must be discussed <br />by the Operator. The Operator is requested to "name" each feature to facilitate the discussions. <br />10 <br />
