DISCHARGED FROM THE MINE, CONSUMED IN THE MINE, AND IMPORTED FOR <br />USE WITHIN THE MINE; A DISCUSSION OF WATER BALANCE WITHIN THE MINE; <br />AND FINALLY, A PROJECTION OF HYDROLOGIC IMPACTS OF MINING. THIS <br />REPORT MUST INCLUDE AN ESTIMATE OF THE ELEVATIONS OF WATER IN THE <br />CALDIROLA MINE. THE REPORT WILL BE DUE QUARTERLY BEGINNING ON JULY 1, <br />1984. <br />Status - In Compliance. Active <br />The condition of this stipulation has been changed by the approval of Technical Revision <br />TR-O1. The quarterly monitoring reports have been changed to biannual submittals. This <br />mine is submitting reports as specified in this technical revision. <br />Stipulation No. 3 <br />PRIOR TO THE USE OF MINE WATER FOR ANY MINING ACTIVITIES OR <br />DEWATERING OF MINE WATER, TWIN PINES COAL COMPANY, INC., MUST OBTAIN <br />ALL STORAGE AND WELL PERMITS REQUIRED BY APPLICABLE STATE LAW. <br />Status - Onooino. Active <br />Water rights for water produced in the mine have not been obtained. Water for beneficial <br />use is being hauled to the site. The State Engineer's Office has indicated that a well <br />permit is required of the activation of any pump extracting water from a mine. Adequacy <br />Question No. 7 has requested that the operator submit an application to obtain a well <br />permit, or provide evidence from the State Engineer's Office that the permit is <br />unnecessary. The Twin Pines Mine has obtained a Mine Water Discharge Permit from the <br />Colorado Department of Health. <br />Stipulation No. 4 <br />PRIOR TO ANY DISTURBANCE IN THE PROPOSED LEWIS GULCH FILL AREA, THE <br />APPLICANT MUST SUBMIT A PLAN WHICH IDENTIFIES A LOCATION FOR STORAGE <br />OF THE TOPSOIL REMOVED FROM THE LEWIS GULCH FILL AREA AND THE <br />DIVISION MUST APPROVE THE PLAN. THIS TOPSOIL STORAGE AREA IS TO BE <br />PROPERLY PROTECTED FROM EROSION USING ADEQUATE DITCHES, BERMS OR <br />OTHER MEASURES. THE APPLICANT MUST ALSO SUPPLY THE DIVISION WITH A <br />PLAN TO RECLAIM THE LEWIS GULCH FILL, INCLUDING A DESCRIPTION OF HOW <br />THE STORED TOPSOIL WILL BE UTILIZED DURING RECLAMATION. <br />Status - In Compliance. Terminated <br />This stipulation has been resolved in the stipulation status letter dated November 6, 1984 <br />and discussion of reclamation on pages 81 (revisedl, 86 (revised) and 88 (revisedl.
