Land anri Coal Ownership at the Havden Gulch 1~Iine <br />The Hayden Gulch Mine is a surface coal mine. The lands for which partial bond release have been <br />requested are privately owned. Ownership of the coal that was mined from the bond release area was <br />county and private. <br />Lands included in the Bond Release Request <br />A total of 364.1 acres was disturbed at Hayden Gulch Ivline. HGCC's current Phase II/IIl partial <br />bond release request covers 357.3 acres in one bond release block as shown on the Phase II/CII Bond <br />Release Map (Drawing No. 1) in the bond release application package. Four parcels which total 6.8 <br />acres are not part of the current bond release request. Those parcels are shown on the Phase II/III <br />Bond Release Map (Drawing No. 1). The four parcels have an extended bond liability period due <br />to shrub augmentation planting on three of the parcels and slump movement on one parcel. <br />The Division's proposed decision regarding release of reclamation liability at Hayden Gulch Mine <br />is presented at the end of this document. The proposed decision applies to the 357.3-acre bond <br />release block and the 918.70 acres of undisturbed lands within the permit area. <br />Dollar Amount of Bond Release Request <br />The Division currently holds a performance bond in the amount of $551,230 from HGCC. Of that <br />amount, HGCC's current request is for release of $528,718, comprised of $196,271 for Phase II <br />release and $332,447 for Phase III release. <br />II. SUbIiVIARY OF THE BOND RELEASE PROCESS <br />Reclamation History of Bond Release-Parcel <br />Reclamation operations immediately followed mining cessation, with the mine pit (areas east of <br />county road) completely backfilled and graded, topsoiled and seeded by the end of 1986. The <br />office, shop, and warehouse facilities were reclaimed in the Fall of 1987. Depending on steepness <br />of slope and availability of equipment, seed was applied by drill seeding, hydro seeding, and <br />hand broadcas[ing. Three different seed mixes were used during reclamation. The bond release <br />block was not fertilized or irrigated. Two sedimentation ponds (explosives area pond and landfill <br />area pond, both west of county road) were reclaimed in 1996 and monitoring wells were <br />reclaimed in October 1998. The application for Phase II and Phase III bond release was received <br />by the Division on September 9, 1996. The Division found the application complete on April 2, <br />1998, after the Division received proof of publication of the applican['s public notice. <br />Hayden Gulch Mine Page 2 May 25, 1999 <br />Phase II/III Bond Release <br />
