Previous Bond Releases <br />The 37.3-acre Phase lI/III bond release request area is contained in 3l9 acres east of County Road <br />53 that underwent Phase I release in 1953 (Bond Release SL-Ol) and ~S.l acres west oFthe County <br />Road tha[ underwent Phase [release in 1997 (Bond Release SL-03). The files for SL-01 and SL-03 <br />contain the Findings documents prepared by the Division. Phase 1 release for SL-O1 and SL-0'' was <br />for: backfilling, grading to approximate original con[our (including variances), draina_e con[rol, and <br />reestablishment of drainage. <br />Submittal Procedures of Current Phase IUIII Release Application and Completeness <br />Determination by the Division <br />HGCC submitted the Phase II/III bond release application following the procedures described in the <br />Act and the Regulations. The application also utilizes the Division's Guideline Rec~ardin2 Selected <br />Coal >Vline Bnnd Release Issues, dated April 18, 199. The application requested release of <br />$501,520 of bond. The Division received the application on February 27, 1998 and, as required by <br />(Section 3.03.2(1)(d), determined that the application was "complete". The completeness <br />determination was made on April 2, 1993, after the Division received proof of publication of the <br />applicant's public notice. By letter of April 30, 1999, HGCC requested that the bond release amount <br />be increased by 527,198 for ground water well reclamation work completed since submittal of the <br />original bond release request. <br />Public Notice <br />HGCC published notice of the bond release application in the Steamboat Pilor once weekly for four <br />consecutive weeks, beginning on February 18, 1993. HGCC also notified landowners within and <br />adjacent to the mine permit azea, and other interested parties of the application for bond release, as <br />required by Section 3.03.2(1). <br />Bond Release Inspection <br />The Division conducted a bond release inspection on June 23, 1998. The site inspection was <br />conducted in accordance with Section 3.03.2(2). Bob Medler represented HGCC. Mike Neumann <br />and John Weinman of TerraMatrix also represented HGCC, as its consultant. David Berry and Tom <br />Kaldenbach represented the Division. Jon Kubic represented the Colorado Water Quality Control <br />Division. <br />Technical Review <br />The Division reviewed technical aspects of HGCC's bond release submittal in order to determine <br />if Phase IUIII bond release is warranted. The review evaluated the methods that HGCC used in <br />gathering and processine the data in the bond release submittal. The review considered the technical <br />validity of the conclusions tha[ HGCC presented in the submittal. The Division also independently <br />analyzed various hydrologic impacts.
