No bond releases have occurred at the HG Loadout. <br />PART III -REQUESTED REVISIONS OF PERMIT APPLICATION <br />Thirty-five deficiencies (Items) within the current permit were identified during this <br />review. The Division requests that the permittee correct the deficiencies by submission of <br />revised permit pages under appropriate revision applications, or by activities on the <br />ground, by January 18, 2006. <br />Item 1. Rules 2.03.5(2)(c) and (e). Page 7, Tab 3. The entry under Statement of Bond <br />Forfeiture does not indicate the current (resolved) status of the bond forfeited in 1986 for <br />Kentucky permit #8980140 (resolved on May 14, 2004, see Stipulation 6, complied with). <br />Please clarify the current status in the Permit Application Package (PAP). <br />Item 2. Rule 2.03.6(1). The legal description provided on page 3-1.1 in Appendix 3-1 <br />does not appeaz, in one traverse segment, to match the permit boundary as illustrated on <br />Drawing 12-1 (referenced as an Exhibit in the appendix). That segment that reads "thence <br />854 feet" should likely read "thence 554 feet". In addition, the HG Shallow Well 1 <br />location and the water line azeas of the permit aze not described. In addition, offsets from <br />the railroad tracks aze used, but the location of the railroad tracks has not been stated. <br />Please revise the PAP to correct the one segment of, and to add the area of the water <br />supply well and water line to, the permit boundary description. Please add text to <br />the legal description provided on page 3-1.1 to describe the location of the centerline <br />of the railroad track. <br />Item 3. Rule 2.03.10(2). Page 10, Tab 3. The address of Mine Safety and Health <br />Administration (MSHA) in the h's~t'lsmissing. Please add the MSHA address to the <br />PAP. <br />Item 4~Rule 2.03.10(4). Page 10, Tab 3. The date of approval of each entry under <br />identification of other licenses and permits is missing. Please add the dates of approval. <br />Item 5. Rules 2.03.11 and 2.07.3(4)(a). Page 11, Tab 3. Some of the application <br />("compliance records") is filed at Hydro-Environmental Solutions, Inc., 57 10`n Street, <br />Suite B, Steamboat Springs, CO 80477. Please describe (complete) where permit <br />documentation is filed. <br />Item 6. Rule 2.04.3(3). No statement was found in the PAP that the permit azea has not <br />been previously mined. Please add such a statement. <br />Item 7. Rule 2.04.7(1)(a)(iv). See also Rules 2.04.7(1)(b) and 2.04.7(4). A complete list <br />of wells was not found in the PAP.
