Rule 5 Inspections, Enforcement and Civil Penalties ................................................................. 8 <br />Section I -History <br />On January 14, 1985, the Division issued mining and reclamation permit number C-84-063 to the <br />Eastside Coal Company, Inc. (Eastside) for operation of the Eastside Mine. The permit was <br />renewed in 1990, 1995, and again in 2000. The most recent five-year-term Permit, hereafter <br />referred to as the permit, expires on January 14, 2005. The deadline for this Midterm Review is <br />July 13, 2002. <br />The Eastside Mine is an underground coal mine located in Gazfield County, Colorado, <br />approximately 3 miles (air) due north of Silt, Colorado. Immediately above the site is the Grass <br />Valley Reservoir, a Colorado State Pazk. County Road 237, also known as Harvey Gap Road, is <br />located on the west side of the stream, across from the portal and facilities area of the mine. The <br />299-acre permit area, all of private land and mineral rights, is located along the bottom of Harvey <br />Gap and on the steep slopes rising to the east. The proposed mine would have affected 167 acres <br />during the life of mine, including 12 acres of surface disturbance for surface facilities and roads. <br />The mine was in intermittent operation, with a number of notifications for temporary cessation, <br />until the Permit was placed in permanent cessation on August 26, 1993. Operations ceased and <br />reclamation of the site began on Januazy 4, 1995. A Phase I bond release was granted on <br />December 13, 1995. A Phase II bond release was granted on August 31, 2001. With the <br />exception of establishing vegetation on reclaimed sediment control features, removal of <br />piezometers, and removal of signage and mazkers, reclamation of the site is complete. <br />Section II -Revisions to the Permit <br />There has been one minor revision, Minor Revision 28, issued since the last Permit Renewal of <br />August 17, 2001. This revision provided a recapitulation of disturbed and reclaimed acreage of <br />the site. <br />Section III -Notices of Violations and Stipulations to the Permit <br />There have been no Notices of Violation (NOV) issued to Eastside Coal Company during the pat <br />three yeazs (the last NOV, CV-96-014, was issued on June 21, 1996).
