Phase III bond release has <br />not been acquired at the site. The existing, valid permit currently covers reclamation operations. <br />The Petmit Application Package (PAP) demonstrates that Eastside Coal Company expects to <br />conduct reclamation operations in accordance with applicable provisions of Rules 2 and 4 (Rule <br />2.01.4). <br />The cuaent permit term is for five yeazs (Rule 2.01.5). <br />There have been no changes in ownership and control information submitted since the renewal of <br />the permit in 2000 (Rule 2.03.1). This information was updated through November 2, 1999. <br />Addresses of the permittee, and owner, are current [Rules 2.03.4(2) and (3)]. There have been no <br />reported changes in (permit) property owners or contiguous landowners [Rules 2.03.4(6) and <br />(7)l• <br />The Mine Safety and Health Administration identification number is OS-02421 [Rule 2.03.4(8)]. <br />The permittee has never had a permit suspended or revoked [Rule 2.03.5(1)(a)]. The permittee <br />has never had a bond forfeited [Rule 2.03.5(1)(b)]. There have been no violations issued to the <br />permittee [Rule 2.03.5(3)] during the past three years. <br />The pemuttee has rights of entry and operation to complete remaining reclamation operations <br />[Rule 2.03.6]. The permit boundary description is current [Rule 2.03.6(1)]. Private mineral <br />estates have not been severed from the private surface estate [Rule 2.03.6(2)]. <br />There are no azeas designated unsuitable for mining nearby. There are no occupied dwellings <br />within 300 feet of surface operations or facilities [Rule 2.03.7]. <br />The permit term is for five years, expiring January 14, 2005 jRule 2.03.8]. <br />The petmittee has maintained appropriate insurance (Rule 2.03.9). The current policy is for <br />$1,000,000 each occurrence for products and personal injury and an aggregate of $2,000,000. <br />The current certificate expires September 1, 2002. <br />The only current other license or permit is the Colorado Pollution Discharge Elimination System <br />under the Colorado Department of Public Health and Environment (CDPHE)(Rule 2.03.10). It <br />expires June 30, 2002. The sedimentation pond has been reclaimed.
