Phase II <br />Up to eighty five percent of the applicable bond amount shall be released upon the establishment of <br />vegetation that supports the approved postmining [and use and which meets an approved success <br />standard for cover. However, no more than sixty (60) percent of the bond shall be released so long as <br />the lands to which the release would be applicable are contributing suspended solids to streamflow or <br />runoff outside the permit area in excess of premising levels as determined by baseline data or in <br />excess of levels determined on adjacent nonmined areas; or until the essential hydrologic functions <br />and agricultural productivity have been reestablished on alluvial valley floors [Rule 3.0.3.1(2)(b)]. <br />The following aze various items associated with Phase II reclamation. <br />a) Vegetation that Supports the Postmining Land Use <br />Approved postmining land uses are identified in Appendix 3 of this Findings Document. <br />b) Vegetation Success Standard for Cover <br />The required revegetation cover standard for the mine is establishment of greater than 90% of the <br />herbaceous cover measured in the undisturbed reference azea 39 <br />c) Vegetation Success Standard for Alluvial Valley Floors <br />A small portion of the reclaimed area consisting of the conveyor corridor to the former load out is <br />located in the Roazing Fork River alluvial. valley floor (AVF) in Garfield County. Essential <br />hydrologic function and agricultural productivity need to be re-established on alluvial valley floors. 40 <br />d) Vegetation Success Standard for Diversity <br />Diversity is not a requirement for Phase II Bond Release. However, the Division evaluates the <br />vegetation data and determines if the site is approaching the requirements for successful diversity. <br />The reclamation diversity success standazd for the North Thompson Creek Mine consists of <br />establishment of four (4) perennial species, each consisting of a minimum of 3 percent relative cover, <br />but less than 60 percent relative cover.
