e) Replacement of Topsoil
Replacement of topsoil may be considered an element of either Phase I or Phase II work. This mining
operation was active before and at the time of issuance of the initial permit. There was insufficient
material to cover the entire site. Available soils were analyzed for suitability as plant growth media
and found to be suitable with the addition of certain amendments. No topsoil was reportedly available
for the No. 1 or No. 3 Mine portal areas az.
fl Revegetation Retainage
When determining the amount of bond to be released, the Board or Division shall retain that amount
of band for the revegetated area which would be sufficient for a third party to cover the cost of
reestablishing revegetation at any rime during the period specified for permittee responsibility for
revegetation described in 3.02.3 [Rule 3.03.1(3)(a)].
g) Bond for Remaining Reclamation Work
The Division shall not release any amount under performance bonds applicable to a permit if such
release would reduce the total remaining amount under performance bonds to nn amount less than
that necessary for the Division to complete the approved reclamation plan [Rule 3.03.1(3)(d)J.
h) Minimum Bond
in no case shall the total bond amount applicable to a permit area be less than $10,000, in
accordance with 3.02.2(3), until bond for the entire pennit area is fully released [extract from Rule
3.03.1(4)].
III. Results of previous inspections and water monitoring
conducted pursuant to Rules 4.05.13 and 5.02 were considered. The purpose of the inspection was to
evaluate [Rule 3.03.2(2)] that reclamation operations alleged to have been completed had been
completed, the degree of difficulty to complete remaining reclamation, pollution of surface or
subsurface water, and the probability of future occurrence of such pollution.
Vegetation present at the mine site is identified in the PAP, Appendix 3-X, a report on Phase II and
III Bond Release Revegetation Success Sampling February, 2001. It was also identified during a
Division monthly inspection of October 16, 2001 as
az PAP page 4-47
d3 Division inspection report issued October 26, 2001
SL-04, C-81-025
November 13, 2001
Page 10 of 16 Pages
