This Application (SL-04) <br />includes a request for release from bond requirements for some accomplished Phase II reclamation <br />work. This Phase II portion of the proposed release applies to reclamation a[ the mine site (including <br />the Middle Thompson Creek portal azea, the Stoney Ridge fan site in the Middle Thompson Creek <br />drainage, the Stoney Ridge fan shaft road), the loadout site, and to reclamation requirements at the <br />Portal 1 disturbance, the water treatment system, and the two permanent sediment ponds. <br />A Phase III bond release is appropriate when the permittee has successfully completed all surface coal <br />mining reclamation operations in accordance with the approved reclamation plan, and the final <br />inspection and procedures of Rule 3.03.2 have been satisfied. This Application does not include a <br />request for release of Phase III bond requirements. <br />An overview of bond status on this permit is presented in Appendix 1 of this Findings Document. <br />Criteria <br />Phase I <br />Up to sixty percent of the applicable bond amount shnl[ be released when the permittee successfully <br />completes backfilling, regrading, and drainage control in accordance with the approved reclamation <br />plan [Rule 3.03.1(2)(a)]. <br />The approved reclamation plan for the mine site is described on pages 4-46 through 4-73 of the <br />Permit. The approved reclamation plan for the loadout site is described on pages 4-74 through 4-100 <br />of the Permit. <br />Demolition of structures was considered in SL-O1 on this permit. The flume bases aze a remnant of <br />this work. The Crystal River Ranch expressed a desire to retain the bases in place (the two flumes on <br />the Middle Thompson Creek are on Crystal River Ranch land). However, the Division finds that the <br />bases of the flumes do not meet the criteria of Rules 4.05.13(3) (the bases aze no longer required) or <br />4.30.2(2) (suitable for postmining land use) for retention. Mr. Jilfry of the Crystal River Ranch <br />expressed interest in retaining the Stoney Ridge road bridge in place to support postmining land use <br />(as is the Stoney Ridge road). However, the approved reclamation plan of the permit requires its <br />removal.
