sites. She asked that she be notified of the pending on-site inspection by the Division. The second was <br />from the U. S. Forest Service (USFS) 32. The portion of their letter that applies to this bond release <br />concerns joining the Division on a tour of the reclaimed mine site and retention of the bases of flumes <br />if on Forest Service land. The Division has determined that a USFS letter of December 11, 1989 <br />referenced in the USFS letter of August 27, 2001, pertains to a different mine, and the reclamation <br />requested in the letter of December 11, 1989 is, therefore, not the subject of this bond release request <br />(SL-04). The third was from [he Bureau of Land Management (BLM), which requested a copy of the <br />(Division) inspection report and information regarding the quality of North Thompson Creek water as <br />it leaves the permit azea (as such waters may cross BLM land) 33. Two were from the Crystal River <br />Ranch. One was expressing a desire to retain the flume bases in place 34. The other, an expression of <br />interest by Clint Jilfry 35, was in keeping the Stoney Ridge road bridge over North Thompson Creek <br />in place. The sixth expression of interest was from Mr. J. Burtazd. Mr. Burtard expressed an interest <br />sbduring a chance meeting at the mine site. His concern was weed control and the condition of Pitkin <br />County Road 001 in the vicinity of the Portal 1 azea. <br />The Division conducted an on-site inspection of the reclaimed site on September 11, 2001 [Rule <br />3.03.2(2)] and a follow up inspection on October 16, 2001. Persons attending the on-site inspection <br />were James E. Stover (Applicant), Henry Austin (OSM), Janet Buck (City of Cazbondale), Kent <br />Wellner (U. S. Forest Service), and Daniel I. Hernandez and Byron G. Walker (Division). Persons on <br />the follow up inspection were Ms. Buck, Janet Binns (Division) and Byron G. Walker. Although <br />landowners had been notified, none attended either of the inspections. <br />II. Criteria And Schedule For Bond Release <br />Schedule <br />Bond releases are processed in three phases. A Phase I bond release applies to areas where backfilling, <br />(sometimes demolition), regrading and drainage control have been accomplished 37. Verification of <br />topsoil replacement may occur at Phase I or at Phase II. This Application (SL-04) includes release of <br />bond applicable to Phase I and Phase II reclamation requirements of Portal 1 disturbance, the water <br />treatment system, and the two permanent sediment ponds.
