Procedures and Summary Of The Review Process <br />Bond releases are initiated by a permittee of a coal mine in the form of an application 25. The <br />application requires a number of actions of the permtttee, including public notice of submission of the <br />application. Upon receipt of an application, the Division reviews the application for completeness z6. <br />Subsequent to a determination that an application is complete, the Division conducts an on-site <br />inspection and evaluation of the reclaimed site 27. This inspection may occur within thirty days of the <br />application being found complete, weather permitting. Surface owners, Office of Surface Mining <br />(OSM), and other interested parties may participate in the inspection. The Division considers <br />information gained from the inspection, public and agency comments, previous inspections, <br />information presented in the application, and information within permit files, and develops a Findings <br />of Compliance document that summazizes the degree of compliance with the rules associated with the <br />release. Based on the Findings of Compliance, a Proposed Decision is issued 28. The Proposed <br />Decision is made available to the public and interested agencies for 30 days. If uncontested, the <br />proposed decision becomes final 29. if the proposed decision is to approve the bond release, bonds <br />held by the Division may be returned or reduced. If contested, a due process is engaged to determine <br />the fate of the application. <br />This bond release (SL-04) was initiated by Minrec, Inc. by submission of an application (Minrec, Inc., <br />North Thompson Creek Mines Request for Partial Bond Release Permit No. C-81-025) under a J. E. <br />Stover & Associates letter of July 12, 2001. It was received at the Division on July 16, 2001. The <br />Application was found incomplete on May 22, 2001. After deficiencies in the application were <br />corrected, the application was found complete on August 13, 2001. The Applicant had provided proof <br />of publication of a public notice regarding the application in the Glenwood Springs Post Independent. <br />The notice had been published on June 7, 14, 21 and 28, 2001. The Applicant had also notified <br />(Appendix 2 of this Findings Document) landowners within and adjacent to the mine permit azea and <br />other interested parties of the application for bond release so <br />The Division received six expressions of interest in response to notices by the Applicant. One 31 was <br />from Ms. Janet Buck, Town of Carbondale.
