Status - Terminated <br />The Division received a request for an extension to respond to this <br />stipulation in a letter dated December 29, 1993. The Division <br />granted the request; extending the date to January 21, 1994. A <br />faxed response from TerraMatrix was received on January 17, 1994 <br />which agreed with the Division's more conservative angle of draw of <br />27 to 29 degrees. Technical Revision No.19 was received on June <br />16, 1994 to address the boundary changes that the extended angle of <br />draw would incur. TR19 is currently under review for adequacy. <br />Stimulation No. 22 <br />THE OPERATOR WILL SUBMIT TO THE DIVISION BY JANUARY 31, 1994, <br />UPDATES TO ALL POND AS-BUILTS THAT INCLUDE ALL RECENT IMPROVEMENTS <br />ON PONDS 1, 2, 3, 4, 5 AND LOADOUT PONDS L-1 AND L-2. <br />Status - Terminated <br />The updated pond as-builts were received and approved on January <br />31, 1994 via a fax copy. The certified maps were received by the <br />Division on February 2, 1994. <br />Stipulation No. 23 <br />THE OPERATOR AND THE DIVISION WILL RESOLVE OUTSTANDING BOND ISSUES <br />FROM THE MIDTERM REVIEW DURING THE PERMIT RENEWAL PERIOD, JANUARY <br />THROUGH MAY 1994. THE ISSUES THAT WILL BE RESOLVED ARE THE <br />FOLLOWING: REEVALUATION OF THE BOND ESTIMATE SUBMITTED BY THE <br />OPERATOR AND UNTIL RESOLUTION, THAT THE CURRENT BOND AMOUNT OF <br />$849,410.00 WILL REMAIN IN PLACE, AND, SECONDLY, THAT THE FINAL <br />RECLAMATION CONTOURS AT THE LOADOUT WILL BE DETERMINED AFTER REVIEW <br />AND FINAL APPROVAL BY THE DIVISION. <br />Status - Terminated and Replaced <br />The Division initiated a reevaluation of the bond in February 1994, <br />and identified additional concerns. These concerns have been <br />identified in a new stipulation, Stipulation No. 24 (see below). <br />The bond is being reviewed pursuant to the procedures of 3.02.2(4). <br />The bond estimate by the Division was completed on June 17, 1994 <br />and hand delivered to the operator on June 22, 1994. <br />Stipulation No. 24 <br />AS A COMPONENT OF THE 1994 PERMIT RENEWAL AND BOND ESTIMATE REVIEW, <br />THE DIVISION HAS DETERMINED THAT THE CURRENT EFCI RECLAMATION PLAN <br />IS DEFICIENT IN THE FOLLOWING AREAS: <br />1. THE MASS BALANCE FOR THE OVERBURDEN AND TOPSOIL FOR THE FINAL <br />REFUSE PILE CONFIGURATION NEEDS TO BE CALCULATED AND IF ANY <br />10 <br />
