2004 Midterm Review <br />Rule 2.05.3(9) Waste Disposal <br />Some portal mine development materials were backfilled into the portal openings during <br />reclamation. No coal wastes were ever generated. Facilities have been removed other than those <br />permitted as permanent, with the exception of Sedimentation Pond A and a drainage ditch and <br />sump. The PAP is silent on the disposal of structural elements of the pond. The applicant is asked <br />to address this issue. <br />Rule 2.05.4 Reclamation Plan <br />Rule 2.05.4(1) The Plan <br />In compliance (PAP, pages 4-53 through 4-73). Two bond releases has been approved for <br />reclamation at the site. The second, SL-02, granted complete Phase II release of liability <br />(sediment control structures aze managed sepazately). There will be some non-coal wastes <br />generated by demolition of Sedimentation Pond A. The applicant is asked to address the disposal <br />of these wastes in the plan. <br />Rule 2.05.4(2) Contents <br />In compliance. A schedule is on page 4-54 of the PAP. A cost estimate is indicated (see page 4- <br />iii) asTable 4.4-4 on page 4-61 of the PAP, but it is not. The list of exhibits (PAP page 4-iv) <br />indicates a reclamation estimate at Exhibit 4.4-1, but only elements were found during this <br />review. Table 4.4-4, page 4-67, that was deleted from the PAP, was recovered by the applicant <br />and provided to the Division. This cost estimate is the initial (permitted) estimate. The applicant <br />is asked to re-instate this table in the PAP. <br />Rule 2.05.5 Postmining Land Uses <br />In compliance. The applicant proposes to return the land to the permitted postmining land uses of <br />cropland, pasture/wildlife habitat and rangeland/wildlife habitat (PAP, Page 4-53). <br />Rule 2.05.6 Mitigation of the Impacts of Mining Operations <br />Rule 2.05.6(1) Air Pollution <br />The pemuts of the air pollution control plan (PAP, page 4-74) are no longer in effect. There is no <br />source of air pollutant at the site. <br />Rule 2.05.6(2) Fish and Wildlife <br />Most elements of the original plan were accomplished.
