2004 Midterm Review <br />Rule 2.05.2(1) Production <br />In compliance. There has been no, and there is no current or planned, production at the site. <br />Rule 2.05.2(2) Operation <br />In compliance. There are no mining of coal operations. <br />Rule 2.05.3 Operations Plan -Permit Area <br />Rule 2.05.3(1) Production <br />Incompliance. No coal production was ever accomplished at the site. Coal was to be <br />hydraulically mined, dewatered, and shipped by rail. <br />Rule 2.05.3(2) Operation <br />In compliance. Operations never materialized due to premature closure of the project. <br />Rule 2.05.3(3) Facilities <br />Incompliance. Two portals were developed, roads, and sediment control features were <br />constructed. Only a sediment pond and erosion control features aze currently on site. <br />Rule 2.05.3(4) Ponds and Diversions <br />Incompliance. Sedimentation Pond A is still in place, but the contributing watershed has been <br />granted Phase II Bond Release. Some sediment control ditches and a sump are still in place. <br />Rule 2.05.3(5) Topsoil <br />In compliance. Topsoil to be used in reclamation of the sedimentation pond has been stored at <br />two locations (see Figure 4.2-3 of the PAP). <br />Rule 2.05.3(6) Overburden <br />In compliance by exception. No spoil was generated at the underground mine. <br />Rule 2.05.3(7) Coal Handling Structures <br />In compliance by exception. There aze no coal-handling structures on site. <br />Rule 2.05.3(8) Wastes <br />In compliance by exception. There is no coal mine waste at the site. <br />12 <br />
