2004 Midterm Review <br />complete legal description of the permit azea. The access and surface agreement applies to <br />portions of Sections 5, 6 and 8, T 6 S, R 90 W. To demonstrate that the agreement is adequate for <br />continued reclamation, the applicant was asked to add Section lines to Figure 4.7-4, Final <br />Contours. <br />Rule 2.03.7 Areas Designated Unsuitable for Mining <br />In compliance. The Permit area is not within such designated azeas (PAP page 2-7). <br />Rule 2.03.8 Permit Tenn Information <br />In compliance (PAP, page 2-8). The Permit is for afive-year period ending October 9, 2006. <br />Rule 2.03.9 Insurance Information <br />In compliance. The applicant has consistently maintained insurance coverage as verified during <br />quarterly (coal complete) inspections. The current certificate expires 09/01/04. <br />Rule 2.03.10 Other Licenses and Permits <br />In compliance. The only other license or permit currently active is a Colorado Department of <br />Public Health and Environment, Water Quality Control Division, Colorado Wastewater <br />Dischazge Permit. <br />Rule 2.03.11 Location of Public Office <br />In compliance. Copies of applications for revisions, and a copy of the Permit, are maintained at <br />the Garfield County Clerk and Recorders Officer in Glenwood Springs, Colorado, for public <br />review (PAP page 2-10), validated by coal complete inspections accomplished by the Division. <br />Rule 2.03.12 Newspaper Advertisement <br />In compliance. Newspaper notices are consistently placed as appropriate in a local newspaper <br />(PAP, page 2-11), usually the Glemvood Springs Post Independent. <br />Rule 2.04 Application -Information on Environmental Resources <br />In compliance. Adequate environmental resource information was provided for issuance and <br />operations anticipated under the Permit, and remain adequate for the diminished activities of <br />remaining reclamation. <br />Rule 2.04.1 Objectives <br />Incompliance.
