C. Transfer of Wells <br />"fhe pem~ittee does not plan to transfer its two monitoring wells. (4.05.14 (3)j. <br />D. Discharge of Water into an Underground Mine <br />"the Apex No. 2 Mine has not discharged water into an underground working; therefore, <br />specific findings are not required (4.05.16 and 4.03(7)). <br />E. Stream Buffer Zones <br />The reclaimed surface mining operation is within 100 feet of a perennial stream. Sunland <br />Mining Corp. has requested that a variance be given for the stream buffer requirement of <br />Rule 4.0.18. Pursuant to Rule 4.0.18, the Division granted a variance from the stream <br />buffer zone requirement for those permitted surface coal mining operations within l00 <br />feet of Trout Creek. The Division has found that: <br />1. The original stream channel will not be disturbed; <br />2. During and after mining, water along the stream <br />will not be adversely affected; <br />3. The reclamation plan provides for the establishment <br />of riparian vegetation where appropriate; and <br />4. All stream buffer zones will be appropriately marked. <br />Probable Hydrologic Consequences <br />The applicant has predicted on pages 65.01, 6.02 and 69 that the mining operation will <br />not affect the quantity or quality of water in Middle Creek nor will there be appreciable <br />effects to the quantity or quality of water in Trout Creek. <br />The Division has evaluated the detailed hydrology information to determine the probable <br />effects of the mining operation on the prevailing hydrologic balance. The potential effects <br />of the mining operation on the prevailing hydrologic balance are minimal. <br />The possible hydrologic impacts to springs tributary to Middle Creek and the potential <br />adverse effects to the prevailing hydrologic balance of Trout Creek are minimal. The <br />effects have been minimized because the dip of the strata and the mine workings are away <br />from Trout Creek and over 80% of the mine workings are above the piezometric surface. <br />All surface drainage from the reclaimed disturbed area is routed through the <br />sedimentation pond or through approved small area exemptions, thereby minimizing the <br />affects to Trout Creek. Therefore, the Division concludes that there will be no adverse <br />effects from the mining operation due to leachate development from waste material, mine <br />drainage, or dewatering the alluvial aquifer. <br />Apex No. 2 Mine, C-81-01 I ~ 14 Amended December 21, 1998 <br />
