Leidic• • <br />May 30, 2000 <br />Page 2 <br />HISTORY (con't.) <br />- A State Conversion and Amendment of the Mined Land Reclamation Permit <br />(M77-251) was applied for in 1987. <br />This State permit was issued fora 423 acre site rather than the 3 acre site <br />previously approved. <br />The permit included the N % of Section 16,which was not included eazlier; in <br />essence, the legal description changed (see attached map). This N % is zoned A-1 <br />(an expansion of anon-conforming use). <br />The Permit changed the operation from the original "1101imited" (which allows a <br />maximum of 10 acres to be disturbed) to a "112 regular" (allowing a maximum <br />disturbance of 39 acres). The result of this approval allowed 39 acres to be <br />mined where the original approval limited the mining activity to a maximum of 3 <br />acres. <br />• The State permit was reviewed by County staff; it is uncleaz whether William <br />O'Neill was involved in this review. <br />^ No activity has occurred on the N %: of Section 16 since 1986. <br />PERTINENT ZONING RESOLUTION REFERENCES <br />Section 6 of the Zoning Resolution outlines non-conforming uses. Applicable portions of <br />the regulations aze identified below. <br />- Section 6.A.3., "A legal non-conforming use shall not be changed to a different non- <br />conforming use. " <br />- Section 6.A.4., "A legal non-conforming use, if changed to a conforming use, may <br />not thereafter be changed back to any non-conforming use. " <br />- Section 6.A.5., "A legal non-conforming use shall not be extended, expanded or <br />enlarged. Extension, expansion or enlargement shall include, but is not limited to the <br />following. For Land (including mining operations): Any increase in the land area <br />used for any legal non-conforming use or any relocation of said legal non- <br />conforming use to a different area.
