~~ <br />-68- <br />(7) Crusher Site. A small one acre crusher site does not have a sediment <br />control since it is benned to prevent any runoff from leaving the <br />site. Since no discharge occurs, no treatment is needed. <br />(8) Fill Material and Topsoil Stockpile. A small amount of material <br />excavated for the Eagle No. 5 mine fresh water system and associated <br />topsoil does not have a sediment control system. Sediment control <br />would be impractical and unnecessary for such a small site, therefore <br />a small area exemption is granted. <br />No additional variances were requested or granted in this section. <br />The application is in compliance with the requirements of this section <br />for both the Eagle No.5 and i~o. 9 mines. <br />XVIII. Bonding - Rules 2.U5.4(2)(b) and 3 <br />The Division has reviewed Appendix IV-13 of the permit application for <br />compliance with the requirements of this section. <br />The applicant has provided reclamation costs based on Means Site WorK <br />Cost Data Book (1983) and bids from local equipment operators. The <br />Division has reevaluated equipment rental and operation costs based on <br />the above referenced book and found them to be increased. Based on the <br />information presented in the application under operations and bonding, <br />the bond has been reevaluated in the amount of $2,408,900.00. The <br />Division has determined this amount to be sufficient to cover the costs <br />of reclamation at. the Eagle No. 5 and No. 9 mines. <br />Pursuant to Rules 2.07.6(2)(j) and 3.02.1(1), the performance bond in <br />this amount must be filed with the Division prior to permit issuance. <br />The bond must be payable to both the State of Colorado and the United <br />States government. <br />XIX. Sealing of Drilled Holes and Underground Openings - Rules <br />Information regardiny sealing of drilled holes is found in Section 4.28 <br />of the application. A proposed p]an for sealing the portals is found on <br />page IV-14 in Section 4.21 of the application. <br />Empire Energy Corporation states that the mine entrances will be sealed <br />in accordance with approved MSHA plans and regulations. No detailed <br />design for sealing the portal openinys has been provided. In light of <br />the fact that the applicant expects the Eayle No. 5 mine to fill within <br />seven years and discharge to the surface, it is important to have a <br />portal seal that will inini~nize effects to the hydrological balance and is <br />designed for the hydrologic conditions at the mine. Therefore, the <br />following stipulation is necessary. <br />
