..-r <br />-69- <br />Stipulation 21~. <br />GIVEN THE FACT THAT A SUFFICIENT HYDROSTATIC HEAD MAY BUILD UP <br />WITHIN THE COMPLETED EAGLE NU. 5 MINE WORKINGS TO CAUSE MINE <br />WATER DISCHARGES, THE UIVISION DIRECTS EMPIRE ENERGY CORPORATION <br />TO PROJECT THE HYDRAULIC HEAD WITHIN THE MINE AND UEVELUP A PLAN <br />TO SEAL MIi~E OPENINGS TU PREVENT DRAINAGE OF MINE WORKINGS TU THE <br />SURFACE. THIS PLAN MUST SHOW THAT THE WORKINGS WILL BE ABLE TU <br />WITHSTAiVD THE EXPECTED HYDROSTATIC HEAD DEVELUPEU WITHIN THE <br />EAGLE NU. 5 MINE WORKINGS. THIS PLAN SHALL BE SUBMITTED TO THE <br />DIVISION WITHIN UiVE YEAR OF PERMIT ISSUANCE. <br />With the acceptance of this stipulation the Division finds this section <br />in compliance for ooth the Eagle No. 5 and No. 9 mines. <br />XX Subsidence Rules (2.05.6(6), 4.20) <br />A. Inventory of Structures and Renewaole Resource Lands: <br />The amended permit application contains an inventory of structures and <br />renewable resource lands within the proposed permit area. The <br />inventoried structures and renewable resource lands are listed on Taole <br />IV-10 and depicted on Map IV-2. The applicant identifies five residences <br />which originally comprised the employee residence area of Empire <br />Village. Three of these structures are listed as being removed and two <br />remaining portable trailer-type structures are to remain in areas which <br />are, or will be, undermined. The inventory also identifies various mine <br />facilities, an oil pipeline, County Road lU7 (vacated to Empire Energy <br />Corporation), State Highway 13, a Denver - Rio Grande and Western <br />Railroad Spur and irriyation ditches within the proposed permit area. <br />Renewable resource lands identified within the permit area include the <br />alluvial valley floors of the Big Bottom area, the Yampa River and the <br />Williams Fork Rivers, the Yampa and Williams Fork Rivers themselves, and <br />several bedrock aquifers. <br />One additional structure, a private residence not owned by Empire Eneryy, <br />was identified in preliminary versions of the permit application <br />document. References to this structure have been omitted from the <br />amended permit application. This structure, located in the NE quarter of <br />the SE quarter of Section 3U, T6N, R91W, lies within the mining <br />boundaries of the No. 9 Mine. This structure is the suoject of <br />stipulations hereafter. <br />6. Subsidence Survey and Subsidence Prediction <br />The amended permit application includes an analytical projection of <br />worst-case and probable consequences of subsidence within the permit <br />area. Worst-case predicted and maximum predicted (probable) subsidence <br />projections are presented on Table IV-11 of the amended permit <br />application. <br />
