requirements of RMBT's approved reclamation plan and to the regulatory requirements for <br />bond release. <br />Chronoloav of Division's Review of the Bond Release Analication <br />The Division's review of RMBT's bond release application found the following three <br />technical adequacy items: 1) a gully on the site needed repair before the bond release could <br />be approved, 2) the amount of the original bond release request was for $1,546 more than <br />the bond amount shown in the Division's permitting data base, and 3) clarification ofdata in <br />the application. The gully repair was completed on June 25, 2004, and the Division <br />inspected it on July 8, 2004. The Division sent RMBT's consultant an adequacy memo <br />requesting correction of the bond release amount on July 26, 2004, and received a response <br />from the consultant on August 2, 2004 asking to revise the request amount to "all" bond held <br />by the Division, rather than a specific amount. On July 28, 2004 the Division received the <br />the clarification ofdata that the Division had requested. The Division received no written <br />objections, or requests for an informal conference regarding the bond release application. <br />The only comment the Division received was a letter dated 3/23/04 from a landowner, the <br />Ute Mountain Ute Tribe, expressing satisfaction with the final reclamation. <br />III. CRITERIA FOR BOND RELEASE <br />Phase III Bond Release <br />Phase III is a final bond release. The entire permit azea is being considered for Phase III <br />release. A Phase III bond release can occur: <br />1. When the minimum period of liability of 10 yeazs is met. [Section 3.02.3(2)(b)]; <br />2. When the permiee has successfully completed all surface coal mining <br />reclamation operations in accordance with the approved reclamation plan <br />[Section 3.03.1(2)(c)]; <br />3. When all reclamation requirements of the Rules and the Act are fully met <br />[Section 3.03.1(4)]; and <br />4. When the final inspection and evaluation procedures of Section 3.03.2 have been <br />satisfied [Section 3.03.1(2)(c)]. <br />IV. OBSERVATIONS AND FINDINGS <br />Comaletion of Minimum Liability Period <br />The site was seeded 12 yeazs ago (in 1992) and only minor interseeding occurred during the <br />next two years; therefore, the 10-yeaz liability period has expired. <br />
