surface and ground water monitoring structures (0.2 acres), and for the removal of mine <br />identification signs and disturbed area markers. Liability is also retained for surface areas <br />overlying mined regions. <br />Reclamation under this Permit yet to be approved for release consists of removal of the water <br />treatment system, removal of four water-monitoring flume bases, removal of two water- <br />monitoring wells, removal of boundary signs and disturbance azea boundary markers, and <br />establishment of vegetation at the sites of the water monitoring flume bases. The Division has <br />estimated the cost for the Division to conduct this reclamation work to be $42,115. These <br />remaining disturbed azeas tota14.3 acres (4.1 acres associated with the water treatment system <br />and 0.2 acres associated with the flumes and piezometers). Reclamation(removal requirements <br />and associated bond release procedures for these types of liabilities aze discussed in Rules <br />3.03.1(5), 3.06, 4.02.2(3), 4.02.4, 4.05.13(1)(e)(ii) and 4.05.13(3)(a). Rules 3.03.1(5) and 3.06.2 <br />allow certain types of ground disturbances to be exempt from the requirements of the extended <br />liability period described in Rule 3.02.3(2) and the bond release criteria of Rule 3.03.1(2). The <br />Division recognizes the reclamation liability for the mine water treatment facilities as the type of <br />liability described in Rule 3.06, and proposes to retain its jurisdiction over this reclamation <br />liability. The Division further recognizes the reclamation liability for the surface and ground <br />water monitoring facilities as the type of liability described in Rule 3.03.1(5), and proposes to <br />retain its jurisdiction over this remaining reclamation liability. The Division further recognizes <br />its continuing jurisdiction for areas overlying underground mine workings not disturbed by <br />surface mining activity established at the time of and subsequent to issuance of the permanent <br />program permit, though no bond is held for these azeas. The Division recognizes the requirement <br />to remove mine permit signs and markers and retains jurisdiction for this work. <br />The current amount of bond held by the Division for the North Thompson Creek Mines is <br />$100,000. The SL-04 decision required a retention of $45,6121iability ($79,125 at the mine site, <br />$5,795 at the loadout site, and $10,692 for the water treatment facilities). The Division concludes <br />that the entire retained liability of $5,795 for the loadout site is eligible for release. The Division <br />concludes that $47,702 is eligible for release at the mine site. A liability of $42,115 is proposed to <br />be retained for the remaining work described above. Thus a combined total of $53,497 (the entire <br />$5,795 of the loadout site and $47,702 of the mine site) is proposed for release. <br />A reduction in the required bond liability in the amount of $53,497, from $95,612 to $42,115, is <br />warranted. The amount of bond currently held by the Division is $100,000. This proposed <br />decision would allow the Applicant to reduce this bond to $42,115. <br />IV. PROPOSED DECISION <br />Based on this Findings of Compliance, the proposed decision of the Division is to approve, as of <br />March 17, 2003, the Minrec, Inc. Application for Partial Phase III Bond Release (SL-OS) of 2002, <br />a reduction of the required reclamation bond from $95,612 to $42,115.
