Minimum Bond <br />The Division is required to retain a bond amount of $10,000 until the entire permit area is fully <br />released. The Division proposes, however, to retain $42,115 ($36,511, plus $5,604 not requested <br />by the applicant for the removal of flume bases in this Application). <br />Summary and Conclusions <br />Based upon a review of the reclamation work accomplished at the sites, the PAP, the applicant's <br />bond release Application, and the Act and the Rules, the Division finds that Minrec, Inc. has <br />successfully completed required surface coal mining reclamation operations in accordance with <br />the approved reclamation plan and has met all requirements of the Act and the Rules for a Partial <br />Phase I, Partial Phase TI, and Partial Phase III Bond Release in response to the Application. Of the <br />65.2 disturbed-azea/affected-azea acres within the North Thompson Creek Mines Permit, a 2.0- <br />acre section of loadout haul road received Phase I, Phase II, and Phase III bond release in 1993 <br />under SL-04. These 2.0 disturbed-azea affected-azea acres were never removed from the Permit. <br />Of the remaining 63.2 disturbed-azea/affected-area acres, 47.6 acres aze at the mine site and 15.6 <br />acres are at the loadout site. Of the tota165.2 disturbed-azea/affected-azea acres of the current <br />Permit, 22.5 acres (including 2.0 acres of haul road at the loadout site) aze associated with <br />permanent features, 38.4 acres are associated with revegetated areas, 0.2 acres are associated with <br />water monitoring facilities, and 4.1 acres are associated with water treatment facilities. <br />The Division concludes that of the 65.2 affected acres from surface disturbance within the <br />current Permit for the North Thompson Creek Mines, all but less than 0.04 acres at the mine site <br />had been previously granted Phase I and II (or equivalent) bond release by Bond Releases SL-O1, <br />SL-02, and SL-04. The 4.1 acres associated with the Developed Water Resources area is included <br />in the 65.2-acre figure. Equivalent Phase I and equivalent Phase II Bond Release is warranted and <br />hereby proposed for the less than 0.04 acres affected at the permanent Stoney Ridge Fan Shaft <br />Road Bridge in this Application. <br />Of the 65.2 affected acres of surface disturbance within the current Permit for the North <br />Thompson Creek Mines, 2.0 acres at the loadout site have been previously granted Phase III bond <br />release (SL-02), and 4.1 acres associated with the Developed Water Resources and 0.2 acres <br />associated with water monitoring flumes and piezometers have been withdrawn from this SL-OS <br />Application. Phase III Bond Release is warranted for the remaining 58.9 disturbed-area affected <br />acres in this Application. These 58.9 disturbed-area acres aze composed of 15.5 disturbed-azea <br />acres at the loadout site and 43.4 disturbed-area acres at the mine site. The less than 0.04 acres of <br />the Stoney Ridge Fan Shaft Road Bridge (equivalent Phase III bond release) aze included in the <br />43.4 acres at the mine site. <br />The Division concludes that of the 65.2 acres of surface disturbance affected area within the <br />current Permit for the North Thompson Creek Mines, bond is required to be retained, under <br />Rules applicable, for the removal of mine water treatment systems (4.1 acres), for the removal of <br />SL-O5, C-81-025, Mazch 24, 2003 <br />Page 23 of 26 Pages <br />
