area and affected land at the loadout site. This proposal also releases $47,702 of the currently <br />held $89,817 bond liability at the mine site. This proposal includes releases of an equivalent <br />Phase UIUIII liability for the Stoney Ridge Fan Shaft Road Bridge located at the mine site. This <br />proposal retains bond liability of $42,115 for removaUreclamation of the mine water treatment <br />facilities, for removal/reclamation of the remaining ground water and surface water monitoring <br />facilities, and for removal of mine signs and mazkers. This proposal also acknowledges the <br />reclamation liability for the mine water treatment facilities as the type of liability described in <br />Rule 3.06.2 and proposes to retain jurisdiction by the Division over this reclamation liability. <br />This proposal also acknowledges the reclamation liability for the surface and ground water <br />monitoring facilities as the type of liability described in Rule 3.03.1(2) and proposes to retain <br />Division jurisdiction over this remaining reclamation liability. The Division proposes to retain its <br />jurisdiction over the removal of mine permit signs and markers. <br />The Division proposes to retain jurisdiction over 4.3 disturbed-area acres of the 65.2 disturbed- <br />azeaacres in the current Permit. The Division proposes to release an additional 58.9 disturbed- <br />azea/affected-area acres from Phase III Bond liability. The Division also proposes to recognize <br />affected-area release of the 2.0 acres of the section of the loadout haul road approved for Phase I, <br />Phase II and Phase III Bond Release under SL-04. As a result, the total affected-area acreage <br />released would be 60.9 acres. The Division also proposes to retain its jurisdiction for azeas that <br />both overlie underground mine workings associated with the permanent program permit and that <br />lie outside of the footprint of released surface-disturbed azea, even though no bond is held for <br />these azeas. <br />Concurrent with approval of this bond release proposed decision, the Division also proposes to <br />reduce the frequency of inspections required under Rule 5.02.2 of the permitted North Thompson <br />Creek mines and loadout sites to one complete inspection per calendaz quarter. <br />A copy of this Proposed Decision to release Minrec, Inc. for liability for reclamation work as <br />described in the SL-OS Application and this supporting Findings of Compliance is being provided <br />to Minrec, Inc. (permittee), the U.S. Bank N. A., the Gazfield and Pitkin County Commissioners, <br />the Office of Surface Mining, Kent Wellner of the United States Forest Service, Bruce Fowler of <br />the Bureau of Land Management, Janet Buck (Town of Carbondale), owners of the Crystal River <br />Ranch, owners of the North Thompson -Four Mile Mineral and Land Corporation, Jeffery & <br />Bambi Burtard, and the Aspen Glen Golf Company. A copy of this Proposed Decision and <br />Findings of Compliance document will be on file for public inspection at the offices of the <br />Division, 1313 Sherman Street, Room 215; Denver, Colorado, and at the Garfield County Clerk <br />and Recorder's Office, Garfield County Court House, 109 8`h Street, Glenwood Springs, <br />Colorado. <br />Concurrently, the Division is publishing written notice of its proposed decision once a week for <br />two consecutive weeks in the Glenwood Springs Post Independent, a newspaper of general <br />circulation in the locality of the surface coal mining operation.
