the refuse pile and an associated ditch, and the Developed Water Resources facilities. Subsequent <br />to SL-04, the Stoney Ridge Fan Shafr Road Bridge over North Thompson Creek was approved <br />for permanent retention. During the review of this Application (SL-OS), this bridge was found to <br />be eligible for equivalent Phase I bond release. Landowners made written requests for retention <br />of all structures retained not related to permanent drainage features of the approved reclamation <br />plan. <br />Performance bond liability shall extend to the ultimate removal offacilities described in the permit <br />application or reclamation plan as associated with the treatment of mine drainage. <br />The permanent Developed Water Resources area contains water collection systems, ponds, and <br />two monitoring wells. Three of these ponds (the Long Pond, and Treatment Ponds T-1 and T-2) <br />are connected in series, and a fourth pond (P-9) is permitted for use in the series as needed. The <br />water collected and conveyed to the ponds is mine water dischazge from Portals 1 and 3. The <br />Colorado Dischazge Permit System (CDPS) point of compliance for this water is at the outfall <br />from the last pond used in the series (either T-2 or P-9). The Developed Water Resources area <br />was withdrawn from this Application. The Division proposes to retain bond liability for removal <br />of the water treatment facilities. <br />The Division had found earlier, and was aware at the August 6, 2002 inspection, that the bases of <br />four water-monitoring flumes (2 in North Thompson Creek and 2 in Middle Thompson Creek) <br />had not been removed. Due to these bases not being removed by the August 6, 2002 inspection, <br />these bases were withdrawn from this Application (SL-OS). These bases were subsequently <br />removed in November 2002. The Division validated this removal during a November 21, 2002, <br />inspection. Credit for demolition of the flume bases is addressed in the Division's analysis of the <br />cost of remaining reclamation work of this bond release. Bond for reclamation of the flume bases <br />is proposed to be retained at this time. <br />Certain items that require removal aze dependent upon unapproved-P#~ase III-bond release. <br />Approval of this Application allows future removal of two water-monitoring wells (piezometers), <br />Wells D-lA and D-2A. Approval of this Application also provides, in part, a basis for future <br />relocation of the permit boundary via a future technical revision to remove areas of no remaining <br />bond liability from the Permit. The entire Loadout azea of the Permit is an example of such an <br />area. After a reduction in Permit azea, the boundary signs at the Loadout could be removed or <br />relocated as appropriate. Approval of this Application is also the basis for future removal of <br />disturbance area boundary mazkers associated with those azeas released by this Application. As <br />the demolition of the piezometers, reduction in permit area, removal of boundary signs, and <br />removal of disturbed azea mazkers is not proposed by the Applicant at this time, the Division <br />proposes to retain bond for these items. There is no undue degree of difficulty anticipated in the <br />completion of these remaining reclamation requirements. <br />Findings of the document review indicated that backfilling requirements of the approved <br />reclamation plan had been approved and Phase I bond had been released for the work.
