Period Specified for Revegetation Responsibility <br />The period specified for revegetation responsibility is ten years from the date of seeding. Seeding <br />was completed in 1988, thus the period closed in 1998. <br />Permanent Structures <br />All permanent sedimentation ponds, diversions, impoundments, and treatment facilities are to <br />meet criteria specified in the detailed design plan for the permanent structures and <br />impoundments. Such design plans are included in the Permit. <br />Occurrence, Potential For, and Cost of Abatement of Surface or Groundwater Pollution <br />The Division is required to evaluate and consider, among other things, whether pollution of <br />surface or subsurface water is occurring, the probability of future occurrence of such pollution, <br />and the estimated cost of abating such pollution. <br />Liability for Mine Drainage Control Facilities, and Surface and Ground Water Monitoring <br />Facilities <br />The Division is required to consider the removal of mine drainage control and surface and <br />ground water monitoring facilities in determining remaining bond liability. <br />Liability of Areas Overlying Underground Coal Mine Workings <br />The Division may release the bond or reclamation liability for underground workings only after <br />all mining in the area is completed and the major subsidence effects, if any, have been <br />manifested. For areas of extraction, the liability period shall be a minimum of three years after <br />mining. ff revegetation is required because ofsubsidence damage,- the operation would be bound <br />to the liability period for revegetated lands as contained in Rules 3.02.3 and 4.15.7(5). Until a <br />release has been approved, these lands shall remain within fhe approved permit boundary. <br />Mining ceased in 1984. The three-year minimum period of liability expired in 1987. <br />Bond for Remaining Reclamation Work <br />The Division shall not release any amount under performance bonds applicable to a permit if <br />such release would reduce the total remaining amount under performance bonds to an amount <br />less than that necessary for the Division to complete the approved reclamation plan. <br />SL-O5, C-81-025, Mazch 24, 2003 <br />Page 12 of 26 Pages <br />
