<br />ITEM ll 8 AMOUNT - $5000.00 <br />This claim is for additional labor and machine time required <br />by CWL because of the State's negligence by failing to stake <br />the outer limits of grading as required by the contract. <br />CWL asked constantly for staking, but never got an adequate <br />response or any staking. The amount of this claim is <br />justified, due to having to move dirt further and to more <br />confined areas than would have been the case if staked. <br />There were 13,079 cubic yards of earth on the North end of <br />Chens Hill that could have been pushed straight down with a <br />bulldozer if DMG had staked the perimeters the way their <br />maps depicted them. Instead, we had to load and haul with a <br />scraper an average of 1750 feet. If you actually took and <br />built a cross section of the cut yardage it probably doubled <br />to 26,000 cubic yards. All I had asked for was $5,000, not <br />even a fraction of what the real cost was. DMG should have <br />added time to the .contract, for this took 14 1/2 days <br />longer. <br />ITEM 11 9 AMOUNT - $2100.00 <br />The concrete structure (line Item 1~12D) and task 12 of <br />special conditions requires construction of 15 structures <br />within 2200 feet on 150 centers. The State actually <br />required them to he built much closer together. This is a <br />change of conditions and required extra work and extra time, <br />as they are all bunched up in a small valley, making <br />scheduling and construction difficult and time-consuming. <br />The amount of the claim is based on CWL's estimate of lost <br />efficiency. <br />ITEM II 10 AMOUNT - $3500.00 <br />To repair CWL's seed drill, as CWL ...was required to seed into <br />the rock. This was due to a change of conditions. The <br />State indicated that they had enough topsoil to cover the <br />entire project. They were short in all areas. The topsoil <br />borrow areas and some areas that didn't receive topsoil were <br />rock. This rock destroyed CWL's seed drill. <br />The areas where the damage occurred were the topsoil pile <br />areas, as there was no topsoil left there. Also the Fast <br />side of the East pit, below where the topsoil reached, as we <br />were required to seed into the ror_k. <br />ITEM IE 11 AMOUNT - $5500.00 <br />CWL quarried and stockpiled a large quantity of riprap to be <br />used in the East Pit Channel Reconstruction (Bi.d schedule <br />item 1112D, drop structures, task 12). Some of this is still <br />stockpiled on site. All together 9 structures were deleted <br />n <br />
